1.TERM.LandlordleasestoTenantandTenantleasesfromLandlordtheabovedescribedPremises

1.DAMAGEDEPOSIT.UponthedueexecutionofthisAgreement,TenantshalldepositwithLandlordthe

1.USEOFPREMISES.ThePremisesshallbeusedandoccupiedbyTenantandTenant'simmediatefamily,

asaprivatesinglefamilydwelling,andnopartofthePremisesshallbeusedatanytimeduringthetermof
thisAgreementbyTenantforthepurposeofcarryingonanybusiness,profession,ortradeofanykind,or
foranypurposeotherthanasaprivatesinglefamilydwelling.Tenantshallnotallowanyotherperson,
otherthanTenant'simmediatefamilyortransientrelativesandfriendswhoareguestsofTenant,touseor
occupythePremiseswithoutfirstobtainingLandlord'swrittenconsenttosuchuse.Tenantshallcomply
withanyandalllaws,ordinances,rulesandordersofanyandallgovernmentalorquasigovernmental
authoritiesaffectingthecleanliness,use,occupancyandpreservationofthePremises.
1.CONDITIONOFPREMISES.Tenantstipulates,representsandwarrantsthatTenanthasexaminedthe
Premises,andthattheyareatthetimeofthisLeaseingoodorder,repair,andinasafe,cleanand
tenantablecondition.
1.ASSIGNMENTANDSUBLETTING.TenantshallnotassignthisAgreement,orsubletorgrantany
licensetousethePremisesoranypartthereofwithoutthepriorwrittenconsentofLandlord.Aconsentby
Landlordtoonesuchassignment,sublettingorlicenseshallnotbedeemedtobeaconsenttoany
subsequentassignment,sublettingorlicense.Anassignment,sublettingorlicensewithouttheprior
writtenconsentofLandlordoranassignmentorsublettingbyoperationoflawshallbeabsolutelynulland
voidandshall,atLandlord'soption,terminatethisAgreement.
1.ALTERATIONSANDIMPROVEMENTS.Tenantshallmakenoalterationstothebuildingsor
improvementsonthePremisesorconstructanybuildingormakeanyotherimprovementsonthePremises
withoutthepriorwrittenconsentofLandlord.Anyandallalterations,changes,and/orimprovementsbuilt,
constructedorplacedonthePremisesbyTenantshall,unlessotherwiseprovidedbywrittenagreement
betweenLandlordandTenant,beandbecomethepropertyofLandlordandremainonthePremisesat
theexpirationorearlierterminationofthisAgreement.
1.NONDELIVERYOFPOSSESSION.IntheeventLandlordcannotdeliverpossessionofthePremisesto
TenantuponthecommencementoftheLeaseterm,throughnofaultofLandlordoritsagents,then
Landlordoritsagentsshallhavenoliability,buttherentalhereinprovidedshallabateuntilpossessionis
given.Landlordoritsagentsshallhavethirty(30)daysinwhichtogivepossession,andifpossessionis
tenderedwithinsuchtime,TenantagreestoacceptthedemisedPremisesandpaytherentalherein
providedfromthatdate.Intheeventpossessioncannotbedeliveredwithinsuchtime,throughnofaultof
Landlordoritsagents,thenthisAgreementandallrightshereundershallterminate.
1.HAZARDOUSMATERIALS.TenantshallnotkeeponthePremisesanyitemofadangerous,flammable
orexplosivecharacterthatmightunreasonablyincreasethedangeroffireorexplosiononthePremisesor
thatmightbeconsideredhazardousorextrahazardousbyanyresponsibleinsurancecompany.
1.UTILITIES.Tenantshallberesponsibleforarrangingforandpayingforallutilityservicesrequiredonthe
Premises.
1.MAINTENANCEANDREPAIR;RULES.Tenantwill,atitssoleexpense,keepandmaintainthePremises
andappurtenancesingoodandsanitaryconditionandrepairduringthetermofthisAgreementandany
renewalthereof.Withoutlimitingthegeneralityoftheforegoing,Tenantshall:
(a)Notobstructthedriveways,sidewalks,courts,entryways,stairsand/orhalls,whichshallbeused
forthepurposesofingressandegressonly;
(b)Keepallwindows,glass,windowcoverings,doors,locksandhardwareingood,cleanorderand
repair;
(c)Notobstructorcoverthewindowsordoors;
(d)Notleavewindowsordoorsinanopenpositionduringanyinclementweather;
(e)Nothanganylaundry,clothing,sheets,etc.fromanywindow,rail,porchorbalconynorairordry
anyofsamewithinanyyardareaorspace;
(f)Notcauseorpermitanylocksorhookstobeplaceduponanydoororwindowwithouttheprior
writtenconsentofLandlord;
(g)Keepallairconditioningfilterscleanandfreefromdirt;
(h)Keepalllavatories,sinks,toilets,andallotherwaterandplumbingapparatusingoodorderand
repairandshallusesameonlyforthepurposesforwhichtheywereconstructed.Tenantshall
notallowanysweepings,rubbish,sand,rags,ashesorothersubstancestobethrownor
depositedtherein.Anydamagetoanysuchapparatusandthecostofclearingstopped
plumbingresultingfrommisuseshallbebornebyTenant;
(i)AndTenant'sfamilyandguestsshallatalltimesmaintainorderinthePremisesandatallplaces
onthePremises,andshallnotmakeorpermitanyloudorimpropernoises,orotherwise
disturbotherresidents;
(j)Keepallradios,televisionsets,stereos,phonographs,etc.,turneddowntoalevelofsoundthat
doesnotannoyorinterferewithotherresidents;
(k)Depositalltrash,garbage,rubbishorrefuseinthelocationsprovidedthereforandshallnotallow
anytrash,garbage,rubbishorrefusetobedepositedorpermittedtostandontheexteriorof
anybuildingorwithinthecommonelements;
(l)AbidebyandbeboundbyanyandallrulesandregulationsaffectingthePremisesorthe
commonareaappurtenanttheretowhichmaybeadoptedorpromulgatedbythe
CondominiumorHomeowners'Associationhavingcontroloverthem.
1.DAMAGETOPREMISES.IntheeventthePremisesaredestroyedorrenderedwhollyuninhabitableby
fire,storm,earthquake,orothercasualtynotcausedbythenegligenceofTenant,thisAgreementshall
terminatefromsuchtimeexceptforthepurposeofenforcingrightsthatmayhavethenaccruedhereunder.
TherentalprovidedforhereinshallthenbeaccountedforbyandbetweenLandlordandTenantuptothe
timeofsuchinjuryordestructionofthePremises,TenantpayingrentalsuptosuchdateandLandlord
refundingrentalscollectedbeyondsuchdate.ShouldaportionofthePremisestherebyberendered
uninhabitable,theLandlordshallhavetheoptionofeitherrepairingsuchinjuredordamagedportionor
terminatingthisLease.IntheeventthatLandlordexercisesitsrighttorepairsuchuninhabitableportion,
therentalshallabateintheproportionthattheinjuredpartsbearstothewholePremises,andsuchpartso
injuredshallberestoredbyLandlordasspeedilyaspracticable,afterwhichthefullrentshallrecommence
andtheAgreementcontinueaccordingtoitsterms.
1.INSPECTIONOFPREMISES.LandlordandLandlord'sagentsshallhavetherightatallreasonabletimes
duringthetermofthisAgreementandanyrenewalthereoftoenterthePremisesforthepurposeof
inspectingthePremisesandallbuildingsandimprovementsthereon.Andforthepurposesofmakingany
repairs,additionsoralterationsasmaybedeemedappropriatebyLandlordforthepreservationofthe
Premisesorthebuilding.LandlordanditsagentsshallfurtherhavetherighttoexhibitthePremisesandto
displaytheusual"forsale","forrent"or"vacancy"signsonthePremisesatanytimewithinfortyfive(45)
daysbeforetheexpirationofthisLease.Therightofentryshalllikewiseexistforthepurposeofremoving
placards,signs,fixtures,alterationsoradditions,thatdonotconformtothisAgreementortoany
restrictions,rulesorregulationsaffectingthePremises.
1.SUBORDINATIONOFLEASE.ThisAgreementandTenant'sinteresthereunderareandshallbe
subordinate,juniorandinferiortoanyandallmortgages,liensorencumbrancesnoworhereafterplaced
onthePremisesbyLandlord,alladvancesmadeunderanysuchmortgages,liensorencumbrances
(including,butnotlimitedto,futureadvances),theinterestpayableonsuchmortgages,liensor
encumbrancesandanyandallrenewals,extensionsormodificationsofsuchmortgages,liensor
encumbrances.
1.TENANT'SHOLDOVER.IfTenantremainsinpossessionofthePremiseswiththeconsentofLandlord
afterthenaturalexpirationofthisAgreement,anewtenancyfrommonthtomonthshallbecreated
betweenLandlordandTenantwhichshallbesubjecttoallofthetermsandconditionshereofexceptthat
rentshallthenbedueandowingat

1.SURRENDEROFPREMISES.Upontheexpirationofthetermhereof,Tenantshallsurrenderthe
PremisesinasgoodastateandconditionastheywereatthecommencementofthisAgreement,
reasonableuseandwearandtearthereofanddamagesbytheelementsexcepted.
1.ANIMALS.Tenantshallbeentitledtokeepnomorethan__________(____)domesticdogs,catsor
birds;however,atsuchtimeasTenantshallactuallykeepanysuchanimalonthePremises,Tenantshall
paytoLandlordapetdepositof

1.QUIETENJOYMENT.Tenant,uponpaymentofallofthesumsreferredtohereinasbeingpayableby
TenantandTenant'sperformanceofallTenant'sagreementscontainedhereinandTenant'sobservance
ofallrulesandregulations,shallandmaypeacefullyandquietlyhave,holdandenjoysaidPremisesfor
thetermhereof.
1.INDEMNIFICATION.LandlordshallnotbeliableforanydamageorinjuryofortotheTenant,Tenant's
family,guests,invitees,agentsoremployeesortoanypersonenteringthePremisesorthebuildingof
whichthePremisesareapartortogoodsorequipment,orinthestructureorequipmentofthestructureof
whichthePremisesareapart,andTenantherebyagreestoindemnify,defendandholdLandlord
harmlessfromanyandallclaimsorassertionsofeverykindandnature.
1.DEFAULT.AsauthorizedunderAS34.03.220,ifLandlorddeterminesthatTenantisindefaultofthis
Agreement,LandlordshallprovideTenantwiththeappropriatewrittennoticeasspecifiedbelow,and
Tenantshallhavealimitednumberofdaystocurethedefaultunlessotherwiseexcepted.(a)Forthe
failuretopayrentwhendue,LandlordshallprovideTenantwithawrittenNoticeofNonpaymentspecifying
Landlord'sintentiontoterminatethisAgreementiftherentisnotpaid,andTenantshallhaveseven(7)
daysafterthenoticeisdeliveredtopaytherentinarrearsinfull.(b)Foractivitiesincontraventionofthis
Agreement(includingbutnotlimitedtohavingorpermittingunauthorizedpets,guests,orvehicles;parking
inanunauthorizedmannerorpermittingsuchparking;orfailingtokeepthepremisescleanandsanitary),
LandlordshallprovideTenantwithawrittenNoticetoQuitspecifyingtheactsandomissionsconstituting
thebreachandspecifyingthatthisAgreementwillterminateuponadatenotlessthanten(10)daysafter
deliveryofthenoticetoTenant,andTenantshallcuresuchbreachwithinthattimeframe.Ifsubstantially
thesameactoromissionthatconstitutedapriornoncomplianceofwhichnoticewasgivenrecurswithin
six(6)months,LandlordmayterminatethisAgreementuponatleastfive(5)days'writtenNoticetoQuit
deliveredtoTenantspecifyingthebreachandthedateofterminationofthisAgreement.IfTenantfailsto
curethedefaultwithintherequiredtimeframe,LandlordmayimmediatelyterminatethisAgreement,and
TenantshallimmediatelyvacatethePremisesandshallreturnthekeysandallopeningdevicesto
Landlord.However,ifTenant'sdefaultisofanaturethatTenantshouldnotbegivenanopportunitytocure
thedefault(includingbutnotlimitedtosubstantialdamageordestructionofLandlord'sorothertenants'
propertybydeliberateact),LandlordmaydeliverawrittenNoticetoQuittoTenantspecifyingtheact
constitutingthebreachandspecifyingthatthisAgreementwillterminateuponadatethatisnotlessthan
twentyfour(24)hoursafterserviceofthenotice,andTenantshallvacatethepremisesnolaterthanthat
timeandshallreturnthekeysandallopeningdevicestoLandlord.(Damagetopremisesis"substantial"if
theloss,destruction,ordefacementofpropertyattributabletoTenant'sdeliberateinflictionofdamageto
thepropertyexceeds$400.)Inaddition,ifthisAgreementisterminatedpursuanttothisparagraph,
Landlordmay,atLandlord'soption,declaretheentirebalanceofrentpayablehereundertobe
immediatelydueandpayableandmayexerciseanyandallrightsandremediesavailabletoLandlordat
laworinequity.
1.LATECHARGE.IntheeventthatanypaymentrequiredtobepaidbyTenanthereunderisnotmade
withinthree(3)daysofwhendue,TenantshallpaytoLandlord,inadditiontosuchpaymentorother
chargesduehereunder,a"latefee"intheamountof

1.ABANDONMENT.IfatanytimeduringthetermofthisAgreementTenantabandonsthePremisesorany
partthereof,Landlordmay,atLandlord'soption,obtainpossessionofthePremisesinthemanner
providedbylaw,andwithoutbecomingliabletoTenantfordamagesorforanypaymentofanykind
whatever.Landlordmay,atLandlord'sdiscretion,asagentforTenant,reletthePremises,oranypart
thereof,forthewholeoranypartthereof,forthewholeoranypartofthethenunexpiredterm,andmay
receiveandcollectallrentpayablebyvirtueofsuchreletting,and,atLandlord'soption,holdTenantliable
foranydifferencebetweentherentthatwouldhavebeenpayableunderthisAgreementduringthe
balanceoftheunexpiredterm,ifthisAgreementhadcontinuedinforce,andthenetrentforsuchperiod
realizedbyLandlordbymeansofsuchreletting.IfLandlord'srightofreentryisexercisedfollowing
abandonmentofthePremisesbyTenant,thenLandlordshallconsideranypersonalpropertybelongingto
TenantandleftonthePremisestoalsohavebeenabandoned,inwhichcaseLandlordmaydisposeofall
suchpersonalpropertyinanymannerLandlordshalldeemproperandLandlordisherebyrelievedofall
liabilityfordoingso.
1.ATTORNEYS'FEES.AsprovidedunderAS34.03.350,intheeventanydisputearisesbetweenLandlord
andTenantconcerningthisAgreementthatresultsinlitigation,thelosingpartyshallpaytheprevailing
party'sreasonableattorneyfeesandcourtcosts,whichshallbedeterminedbythecourtandmadeapart
ofanyjudgment.
1.RECORDINGOFAGREEMENT.TenantshallnotrecordthisAgreementonthePublicRecordsofany
publicoffice.IntheeventthatTenantshallrecordthisAgreement,thisAgreementshall,atLandlord's
option,terminateimmediatelyandLandlordshallbeentitledtoallrightsandremediesthatithasatlawor
inequity.
1.GOVERNINGLAW.ThisAgreementshallbegoverned,construedandinterpretedby,throughandunder
theLawsoftheStateofAlaska.
1.SEVERABILITY.IfanyprovisionofthisAgreementortheapplicationthereofshall,foranyreasonandto
anyextent,beinvalidorunenforceable,neithertheremainderofthisAgreementnortheapplicationofthe
provisiontootherpersons,entitiesorcircumstancesshallbeaffectedthereby,butinsteadshallbe
enforcedtothemaximumextentpermittedbylaw.
1.BINDINGEFFECT.Thecovenants,obligationsandconditionshereincontainedshallbebindingonand
inuretothebenefitoftheheirs,legalrepresentatives,andassignsofthepartieshereto.
1.DESCRIPTIVEHEADINGS.Thedescriptiveheadingsusedhereinareforconvenienceofreferenceonly
andtheyarenotintendedtohaveanyeffectwhatsoeverindeterminingtherightsorobligationsofthe
LandlordorTenant.
1.CONSTRUCTION.Thepronounsusedhereinshallinclude,whereappropriate,eithergenderorboth,
singularandplural.
1.NONWAIVER.Noindulgence,waiver,electionornonelectionbyLandlordunderthisAgreementshall
affectTenant'sdutiesandliabilitieshereunder.

3.MODIFICATION.Thepartiesherebyagreethatthisdocumentcontainstheentireagreementbetweenthe
partiesandthisAgreementshallnotbemodified,changed,alteredoramendedinanywayexceptthrough
awrittenamendmentsignedbyallofthepartieshereto.

5.NOTICE.AnynoticerequiredorpermittedunderthisLeaseorunderstatelawshallbedeemedsufficiently
