AND the part y of the first part, in compliance with Section 13 of the Lien Law, coven ants that the part y of the
firs t part will receive the co nsiderat ion for this conveya nce and will h old the right t o receive s uch considerat ion
as a trust fund to be app lie d first for the purpos e of paying the c os t of the improvement and will apply the same
first to the pa yment of the c ost of the im provem ent before usin g any part of the t otal of the s ame f or any other
purpose. The word “party” shall be construed as if it read “parties” whenever the sense of this indenture so
requires.
