3. DAMAGE DEPOSIT. Upon the due execution of this Agreement, Tenant shall deposit with Landlord the sum of

4. USE OF PREMISES. The Premises shall be used and occupied by Tenant and Tenant’s immediate family, consisting of

dwelli ng. Tenantshallnotallowanyotherperson,otherthanTenant’simmediatefamilyortransientrelativesandfri endswho
areguestsof Tenant,touseoroccupythePremiseswithoutfirstobtainingLandlord’swrittenconsentt osuchuse. Tenantshall
com ply with any a nd all laws, ordinances, rules and orders of any and all governmental or quasi governmental authorities
affectingthecleanliness,use,occupancy andpreservationofthePremises.
5. CONDITIONOFPREMISES. Tenantstipulates,representsandwarrantsthatTenant hasexaminedthePremises,andthatthey
areatthetimeofthisLeaseingoodorder ,repair,andinasafe,cleanandtenantablecondition.
6. ASSIGNMENT AND SUBLETTING. Tenant shall not assign this Agreement, or sublet or grant any license to use the
Premisesoranypartthereofwithoutthepriorwrittenconsent ofLa ndlord.Aconsent by Landlordtoonesuchassignment,sub
lettingorlicenseshallnotbedeemedtobeaconsenttoanysubsequentassignment,sublettingorlicense.Anassignment,sub
letting or license without the prior written consent ofLandlord or an assignment or subletting by operation of law shall be
absolutelynullandvoidandshall,at Landlord’soption,terminatethi sAgreement.
7. ALTERATIONSANDIMPROVEMENTS. Tenant shallm akenoalt erationstothebuildingsorimprovementsonthePremises
orconstructanybuildingormakeanyotherimprovementsonthePremiseswit houtth epriorwrittenconsentofLandlord.Any
andallalterations,changes,and/orimprovementsbuilt,constructedorplacedonthePremisesby Tenantshall,unlessotherwise
provided by written agreement between Landlord and Tenant, be and become the property of Landlord and remain on the
Premisesatthe expiration orearlierterminationofthisAgreement.

8. NONDELIVERY OF POSSESSION. In the event Landlord cannot deliver possession of the Premises toTenantupon the
com mencementoftheLeaseterm,throughnofaultofLandlordori tsagents,thenLandlordoritsagentsshallhavenoliability,
buttherentalhereinprovidedshallabateuntilpossessionisgiven. Landlordoritsagentsshallhavethirty(30)daysinwhichto
givepossession,andifpossessionistenderedwithinsuchtime,Tenantagreestoacceptthedemi sedPremisesandpaytherental
hereinprovidedfromthatdate.In theeventpossessioncannotbedeliveredwithinsuchtime, throughnofaultofLandlordorits
agents,thenthisAgreementandallr ightshereundershallterm inate.
9. HAZARDOUS MATERIALS. Tenant shall not keep on the Premises any item of a dangerous, flammable or explosive
characterthatmightunreasonablyincreasethedangeroffireorexplosiononthePremisesorthatmightbeconsideredhazardous
orextrahazardousbyanyresponsibleinsurance company.
10. UTILITIES. Tenant shallberesponsibleforarrangingforandpayingforallut ilityservicesrequiredonthePremi ses.
11. MAINTENANCEANDREPAIR;RULES. Tenant will,atitssoleexpense, keepandmaintainthePremisesand appurtenances
in good and sanitary condition and repair during the term of this Agreement and any renewal thereof. Without limiting the
generalityoftheforegoing, Tenant shall:
(a) Notobstructthedriveways,sidewalks,courts,entryways,stairsand/orhalls,whi chshallbeusedforthepurposesofingress
andegressonly;
(b) Keepal lwindows,glass,windowcoverings,doors,locksandhardwareingood,clean orderandrepair;
(c) Notobstructorcoverthewindowsordoors;
(d) Notleavewindowsordoorsinanopenpositionduringanyinclem entweather;
(e) Nothanganylaundry,clothing,sheets,etc.fr omanywindow,rail,porchorbalconynorairordryan yofsamewithinany
yardareaorspace;
(f) Notcauseorpermitanylocksorhookstobepla ceduponanydoororwindowwithoutthepriorwrittenconsentof Landlord;
(g) Keepallairconditioningfilterscleanandfreefromdirt;
(h) Keepalllavatories,sinks,toilets,andalloth erwaterandplumbingapparatusingoodorderan drepairandshallusesame
onlyforthepurposesforwhichtheywereconstructed. Tenantshallnotallowanysweepings,rubbish,sand,rags,ashesor
other substances to be thrown or deposited therein. Any da mage to any such a pparatusand the cost of clearing stopped
plumbingresultingfrommisuse shallbeborneby Tenant;
(i) AndTenant’sfamil yandguestsshallatalltimesmaintainorderinthePremisesandatallplacesonthePremises, andshall
notmakeorpermitanyloudorimpropernoises,orotherwisedisturbotherresidents;
(j) Keepallradios,televisionsets,stereos, phonographs, etc.,turneddowntoalevelofsoundthatdoesnotannoyorinterfere
withotherresidents;
(k) Depositalltrash,garbage,rubbishorrefuseinthe locationsprovi dedthereforandshallnotallowanytrash,garbage,rubbish
orrefusetobedepositedorpermittedtostandontheexteriorof anybui ldingorwithinthecommonelements;
(l) AbidebyandbeboundbyanyandallrulesandregulationsaffectingthePremisesorthecommonareaappurt enantthereto
whichmaybeadoptedorpromulgatedbytheCondominiumorHomeowners’ Associationhavingcontroloverthem.
12. INSURANCE.Landlord,Landlord’sagentormana ger,or,ifapplicable,theCondominiumor Homeowners’Association,are
notresponsibleforinsuringTenant’s orTenant’spermittedvisitors’personalpropertyandvehiclesagainst lossordamagedueto
theft,vandalism,fire,water,rain,criminalornegligenta ctsofothers,oranyothercause. LandlordhasadvisedTenant tocarry
Tenant’sowninsurance(renter’sinsurance)toprotectTenantfromanysuchlossordamage.Thepartiesagreethat,upon
notificationbyLandlord,Tenantshall takeallactionsnecessary toavoid:(i)anincrease inLandlord’sinsurance premium(or
Tenantshal lpayfortheincreaseinprem ium);or(ii)lossofinsuran ce.
13. DAMAGE TO PREMISES. In the event the Premises are destroyed or rendered wholly uninhabitable by fire, storm,
earthquake,orothercasualtynotcausedbythenegligenceofTenant,thisAgreementshall terminatefromsuchtimeexceptfor
thepurposeofenforcingrightsthatmayhavethenaccruedhereunder.Therentalprovidedforhereinshallthenbeaccountedfor
byandbetweenLandlordandTenantuptothetimeofsuchinjuryordestructionofthePremises,Tenantpayingrental supto
such date and Landl ord refundingrentals collected beyond such da te. Should a porti on of t he Premises thereby be rendered
uninhabitable,the Landlord shallhavetheoptionofeitherrepairingsuchinjuredordamagedportionorterminatingthisLease.In
theeventthatLandlordexercisesitsrightt orepair suchuninhabitableportion,therentalshallabateinth eproportionthatthe
injuredpartsbearstot hewholePremises,andsuchpart soinjuredshallberest oredbyLandlordasspeedilyaspracticable,after
whichthefullrentshal lrecommen ceandtheAgreementcontinueaccordingtoitsterms.
14. INSPECTIONOFPREMISES. LandlordandLandlord’sagentsshallhavetherightatallreasonabletimesduringthetermof
thisAgreementandanyrenewalthereoftoenterthePremisesforthepurposeofinspectingthePremisesanda llbuildingsand
improvementsthereon.Andforthepurposesofmakinganyrepairs,additionsoralterationsasm aybedeemedappropriateby
Landlordforthepreser vationofthePremisesorthebuilding. Landlordanditsagentsshallfurtherhavetheright toexhibi tthe
Premisesandtodisplaytheusual“forsale”,“forrent”or“vacancy”signsonthePremisesatanytimewithinfortyfive (45)days

beforetheexpirationofthisLease.Therightofentryshalllikewiseexistforthepurposeofremovingpla cards,signs,fixtures,
alterations,oradditionsthatdonotconformtothisAgreementor toanyrestri cti ons,rulesorregulati onsaffectingth ePremises.
15. SUBO RDINATION OF LEASE. This Agreement and Tenant’s interest hereunder are and shall be subordinate, junior and
inferiortoanyandallmortgages, liensorencumbrancesnoworhereafterplacedonthePremisesby Landlord,alladvancesmade
underanysuchmortgages,liensorencumbrances(including,butnotli mitedto,futureadvances),theinterest payabl eonsuch
mortgages, li ens or encum brances and any and all renewals, extensions or modifi cat ions of such mortgages, liens or
encumbrances.
16. TENANT’S HOLD OVER. IfTen antremains in possession of t he Premises with the consent of Landlord a fter the nat ural
expirationofthisAgreement,anewtenancyfromm onthtomonthshallbecreatedbetweenLandlordandTenantwhichshallbe
subjecttoallofthetermsandconditionshereofexceptthatrentshallthenbedueandowi ngat___________________________

suchtenancy shallbeterminableuponth irty(30)dayswrittennoticeservedbyeitherparty.
17. SURRENDEROFPREMISES.Upontheexpirationofthetermhereof,Tenantshallsurrenderth ePremisesinasgoodastate
andconditionastheywere atthecommencementofthisAgreement,r easonabl euseandwearandtearthereof anddamagesby the
elements excepted.
18. ANIMALS. T enantshallbeentitl edtokeepnomorethan ____________(_____)domesticdogs,catsorbirds;however,atsuch
time as Tenant shall actually keep any such animal on the Premises, Tenant shall pay to Landl ord a pet deposit of

performance of all Tenant’sagreements cont ainedherein andTenant’s observance of allrules andregulations, shallandmay
peacefullyandquietlyhave,hol dandenjoysaidPremisesforthetermhereof.
20. INDEMNIFICATION. Landlord shall not be liable for any damage or injury of or to theTenant, Tenant’s family, guests,
invitees,agentsoremployeesortoanypersonen teringthePremisesorthebuildingofwhichthePremisesareapartortogoods
or equipment,orinthestructureor equipmentof t hestructureof whichthePremisesareapart,andTenanthereby a greesto
indemnify,defendandhol dLandlord harmlessfromanyandallclaimsorassertionsofeverykindandnature.
21. DEFAULT.If Tenantfailstocomplywithanyofthem aterialprovisionsof thisAgreement,otherthanthecovenanttopayrent,
orofanypresentr ulesandregulationsoran ythatma ybehereafter prescribedby Landlord, ormateriallyfailstocomplywithany
duties imposed on Tenant by statute, within seven (7) days aft er delivery of written notice by Landlord specifying the non
com plian ce and indicating the intention of Landlord to terminate the Lease by reason thereof, Landlord m ay terminate this
Agreement. If Tenant fails to pay rent when due and the default continues for seven (7) days thereafter, Landlord may, at
Landlord’soption,declaretheentirebalanceofrentpayablehereunder tobeimmediatelydueandpayableandmayexerciseany
andallrightsandremediesava ilableto Landlord atlaworinequityormayimmediatelyterminatethisAgreement.
22. LATECHARGE. Intheeventthatanypaymentrequiredt obepaidbyTenanthereunderisnotmadewithinfive(5)ca lendar
daysofwhendue,TenantshallpaytoLandlord, inadditiontosuchpaymentorotherchargesduehereunder,a“latefee”inthe

23. ABANDONMENT. If at any time during th e term of this Agreement Tenant abandons the Premises or any part thereof,
Landlordmay, atLandlord’soption,obtainpossessionofthePremisesinthemanner providedbylaw,a nd withoutbecoming
liabletoTenan tfordamagesorfor anypaymentofanykindwhatever. Landlordmay, a tLandlord’sdiscretion,asagentfor
Tenant,reletthePremises,oranypartth ereof,forthewholeoranypartth ereof,forthewholeoranypartofthethenunexpired
term, andmayreceiveandcollectallrentpayablebyvirtueofsuchreletting,and,atLandlord’soption,holdTenant liableforany
differencebetweentherentthatwouldhavebeenpayableunderthisAgreementduringthebalanceoftheunexpiredt erm,ifthis
Agreementhadcontinuedinforce,andthenetrentforsuchperiodrealized by Landlordbymeans of such reletting.If Landlord’s
right of reentry is exercised following abandonment of the Pr emi ses by Tenant, then Landlord shall consider any per sonal
propertybelongingtoTenantandleftonthePremisestoalsohavebeenabandoned,inwhichcaseLandlordmaydisposeofall
suchpersonalpropertyinanymannerLandlordshalldeemproperandLandlord i sherebyrelievedofallliabilityfor doingso.

24. ATTORNEYS’ FEES. Should it become necessary for Landlord to employ an attorney to enforce any of the conditions or
covenantshereof,includingthecollectionofrentalsorgainingpossessionofthePremises, Tenantagreestopayallexpensesso
incurred,includingareasonableattorneys’fee.
25. RECORDINGOFAGREEMENT. T enantshall notrecordthisAgreementonthePublicRecordsofanypubl icoffice.Inthe
eventthatTenantshallrecordthisAgreement,thisAgreementshall,atLandlord’soption,terminateimmediatelyandLandlord
shallbeentitledtoallrightsandremediesthatithasatlaworinequity.
26. GOVERNINGLAW.ThisAgreementshallbegoverned,construedandinterpretedby,throughandundertheLawsof the State
of NorthCarol ina.
27. SEVERAB ILITY. If any provision of thi s Agreement or the appl ication thereof shal l, for any reason and to a ny ext ent, be
invalidorunenforceable,neithertheremainderofthisAgreementnortheapplicationoftheprovisiontootherpersons,entitiesor
circumstancesshallbeaffectedthereby,butinsteadshallbeen forcedt othemaximum extentpermittedbyl aw.
28. BINDINGEFFECT.Thecovenants,obl igationsandconditionshereincontainedshallbebindingonandinuretoth ebenefitof
theheirs,legalrepresentatives,andassignsofthe partieshereto.
29. DESCRIPTIVE HEADINGS. Th e descript ive headings used hereinare for convenience of reference only andthey are not
intendedtohaveanyeffectwhatsoeverindeterminingtherightsorobligationsof the Landlord orTenant.
30. CONSTRUCTION.Thepronounsusedhereinshallinclude,whereappropriate,eithergender orboth,singularandplural.
31. NONWAIVER.Noin dulgence,waiver,electionornonelectionby LandlordunderthisAgreementshallaffectTenant’sduties
andliabi litieshereunder.
32. MODIFICATION. The parties hereby agree that this document contains the entire agreement betwe en the parties and this
Agreementsha llnotbemodified,changed,a lteredoramendedinanywayexceptthroughawrittenamendmentsignedbyallof
thepartieshereto.
33. NOTICE.AnynoticerequiredorpermittedunderthisLeaseorunderstatelawshallbedeemedsufficien tlygivenorservedif
sentbyUnitedStatescertifiedmail,returnreceiptrequested,addressedasfollows:
