THIS LEASE AGREEMENT (h ereinafter referred to as the Agreement”) made and entered into this ____________ day of

3. DAMAGE DEPOSIT. Upon the due execution of this Agreement, Tenant shall deposit with Landlord the sum of

4. USE OF PREMISES. The Premises shall be used and occupied by Tenant and Tenant’s immediate family, consisting of

singlefamilydwellin g,andnopartofthePremisesshallbeusedatanytimeduringthetermofthisAgreementby Tenantforthe

dwelli ng. Tenantshallnotallowanyotherperson,otherthanTenant’simmediatefamilyortransientrelativesandfri endswho
areguestsof Tenant,touseoroccupythePremiseswithoutfirstobtainingLandlord’swrittenconsentt osuchuse. Tenantshall
com ply with any a nd all laws, ordinances, rules and orders of any and all governmental or quasi governmental authorities
affectingthecleanliness,use,occupancy andpreservationofthePremises.
5. CONDITIONOFPREMISES. Tenantstipulates,representsandwarrantsthatTenant hasexaminedthePremises,andthatthey
areatthetimeofthisLeaseingoodorder ,repair,andinasafe,cleanandtenantablecondition.
6. ASSIGNMENT AND SUBLETTING. Tenant shall not assign this Agreement, or sublet or grant any license to use the
Premisesoranypartthereofwithoutthepriorwrittenconsent ofLa ndlord.Aconsent by Landlordtoonesuchassignment,sub
lettingorlicenseshallnotbedeemedtobeaconsenttoanysubsequentassignment,sublettingorlicense.Anassignment,sub
letting or license without  the prior written consent ofLandlord or an assignment or subletting by operation of law shall be
absolutelynullandvoidandshall,at Landlord’soption,terminatethi sAgreement.
7. ALTERATIONSANDIMPROVEMENTS. Tenant shallm akenoalt erationstothebuildingsorimprovementsonthePremises
orconstructanybuildingormakeanyotherimprovementsonthePremiseswit houtth epriorwrittenconsentofLandlord.Any
andallalterations,changes,and/orimprovementsbuilt,constructedorplacedonthePremisesby Tenantshall,unlessotherwise
provided by written agreement between Landlord and Tenant, be and become the property of Landlord and remain on the
Premisesatthe expiration orearlierterminationofthisAgreement.

8. NONDELIVERY OF POSSESSION.  In the event Landlord cannot deliver possession of the Premises toTenantupon the
com mencementoftheLeaseterm,throughnofaultofLandlordori tsagents,thenLandlordoritsagentsshallhavenoliability,
buttherentalhereinprovidedshallabateuntilpossessionisgiven. Landlordoritsagentsshallhavethirty(30)daysinwhichto
givepossession,andifpossessionistenderedwithinsuchtime,Tenantagreestoacceptthedemi sedPremisesandpaytherental
hereinprovidedfromthatdate.In theeventpossessioncannotbedeliveredwithinsuchtime, throughnofaultofLandlordorits
agents,thenthisAgreementandallr ightshereundershallterm inate.
9. HAZARDOUS MATERIALS. Tenant shall not keep on the Premises any item of a dangerous,  flammable or explosive
characterthatmightunreasonablyincreasethedangeroffireorexplosiononthePremisesorthatmightbeconsideredhazardous
orextrahazardousbyanyresponsibleinsurance company.
10. UTILITIES. Tenant shallberesponsibleforarrangingforandpayingforallut ilityservicesrequiredonthePremi ses.
11. MAINTENANCEANDREPAIR;RULES. Tenant will,atitssoleexpense, keepandmaintainthePremisesand appurtenances
in good and sanitary condition and repair during the term of this Agreement and any renewal thereof. Without limiting the 
generalityoftheforegoing, Tenant shall:
(a) Notobstructthedriveways,sidewalks,courts,entryways,stairsand/orhalls,whi chshallbeusedforthepurposesofingress
andegressonly;
(b) Keepal lwindows,glass,windowcoverings,doors,locksandhardwareingood,clean orderandrepair;
(c) Notobstructorcoverthewindowsordoors;
(d) Notleavewindowsordoorsinanopenpositionduringanyinclem entweather;
(e) Nothanganylaundry,clothing,sheets,etc.fr omanywindow,rail,porchorbalconynorairordryan yofsamewithinany
yardareaorspace;
(f) Notcauseorpermitanylocksorhookstobepla ceduponanydoororwindowwithoutthepriorwrittenconsentof Landlor
(g) Keepallairconditioningfilterscleanandfreefromdirt;
(h) Keepalllavatories,sinks,toilets,andalloth erwaterandplumbingapparatusingoodorderan drepairandshallusesame
onlyforthepurposesforwhichtheywereconstructed. Tenantshallnotallowanysweepings,rubbish,sand,rags,ashesor
other substances to be thrown or deposited therein. Any da mage to any such a pparatusand the cost of clearing stopped
plumbingresultingfrommisuse shallbeborneby Tenant;
(i) AndTenant’sfamil yandguestsshallatalltimesmaintainorderinthePremisesandatallplacesonthePremises, andshall
notmakeorpermitanyloudorimpropernoises,orotherwisedisturbotherresidents;
(j) Keepallradios,televisionsets,stereos, phonographs, etc.,turneddowntoalevelofsoundthatdoesnotannoyorinterfere
withotherresidents;
(k) Depositalltrash,garbage,rubbishorrefuseinthe locationsprovi dedthereforandshallnotallowanytrash,garbage,rubbish
orrefusetobedepositedorpermittedtostandontheexteriorof anybui ldingorwithinthecommonelements;
(l) AbidebyandbeboundbyanyandallrulesandregulationsaffectingthePremisesorthecommonareaappurt enantthereto
whichmaybeadoptedorpromulgatedbytheCondominiumorHomeowners’ Associationhavingcontroloverthem.
12. INSURANCE.Landlord,Landlord’sagentormana ger,or,ifapplicable,theCondominiumor Homeowners’Association,are
notresponsibleforinsuringTenant’s orTenant’spermittedvisitors’personalpropertyandvehiclesagainst lossordamagedueto
theft,vandalism,fire,water,rain,criminalornegligenta ctsofothers,oranyothercause. LandlordhasadvisedTenant tocarry
Tenant’sowninsurance(renter’sinsurance)toprotectTenantfromanysuchlossordamage.Thepartiesagreethat,upon
notificationbyLandlord,Tenantshall takeallactionsnecessary toavoid:(i)anincrease inLandlord’sinsurance premium(or
Tenantshal lpayfortheincreaseinprem iumor(ii)lossofinsuran ce.
13. DAMAGE TO PREMISES. In the event the Premises are destroyed or rendered wholly uninhabitable by fire, storm,
earthquake,orothercasualtynotcausedbythenegligenceofTenant,thisAgreementshall terminatefromsuchtimeexceptfor
thepurposeofenforcingrightsthatmayhavethenaccruedhereunder.Therentalprovidedforhereinshallthenbeaccountedfor
byandbetweenLandlordandTenantuptothetimeofsuchinjuryordestructionofthePremises,Tenantpayingrental supto
such date and Landl ord refundingrentals collected beyond such da te. Should a porti on of t he Premises thereby be rendered
uninhabitable,the Landlord shallhavetheoptionofeitherrepairingsuchinjuredordamagedportionorterminatingthisLease.In
theeventthatLandlordexercisesitsrightt orepair suchuninhabitableportion,therentalshallabateinth eproportionthatthe
injuredpartsbearstot hewholePremises,andsuchpart soinjuredshallberest oredbyLandlordasspeedilyaspracticable,after
whichthefullrentshal lrecommen ceandtheAgreementcontinueaccordingtoitsterms.
14. INSPECTIONOFPREMISES. LandlordandLandlord’sagentsshallhavetherightatallreasonabletimesduringthetermof
thisAgreementandanyrenewalthereoftoenterthePremisesforthepurposeofinspectingthePremisesanda llbuildingsand
improvementsthereon.Andforthepurposesofmakinganyrepairs,additionsoralterationsasm aybedeemedappropriateby
Landlordforthepreser vationofthePremisesorthebuilding. Landlordanditsagentsshallfurtherhavetheright toexhibi tthe
Premisesandtodisplaytheusualforsale”,forrent”orvacancy”signsonthePremisesatanytimewithinfortyfive (45)days

beforetheexpirationofthisLease.Therightofentryshalllikewiseexistforthepurposeofremovingpla cards,signs,fixtures,
alterations,oradditionsthatdonotconformtothisAgreementor toanyrestri cti ons,rulesorregulati onsaffectingth ePremises.
15. SUBO RDINATION OF LEASE. This Agreement and Tenant’s interest hereunder are and shall be subordinate, junior and
inferiortoanyandallmortgages, liensorencumbrancesnoworhereafterplacedonthePremisesby Landlord,alladvancesmade
underanysuchmortgages,liensorencumbrances(including,butnotli mitedto,futureadvances),theinterest  payabl eonsuch
mortgages, li ens or encum brances and any and all renewals, extensions or modifi cat ions of such mortgages, liens or
encumbrances.
16. TENANT’S HOLD OVER. IfTen antremains in possession of t he Premises with the consent of Landlord a fter the nat ural
expirationofthisAgreement,anewtenancyfromm onthtomonthshallbecreatedbetweenLandlordandTenantwhichshallbe 
subjecttoallofthetermsandconditionshereofexceptthatrentshallthenbedueandowi ngat___________________________

suchtenancy shallbeterminableuponth irty(30)dayswrittennoticeservedbyeitherparty.
17. SURRENDEROFPREMISES.Upontheexpirationofthetermhereof,Tenantshallsurrenderth ePremisesinasgoodastate
andconditionastheywere atthecommencementofthisAgreement,r easonabl euseandwearandtearthereof anddamagesby the
elements excepted.
18. ANIMALS. T enantshallbeentitl edtokeepnomorethan ____________(_____)domesticdogs,catsorbirds;however,atsuch
time as Tenant shall actually keep any such  animal on the Premises, Tenant shall pay to Landl ord a  pet deposit of

performance of all Tenant’sagreements cont ainedherein andTenant’s observance of allrules andregulations, shallandmay
peacefullyandquietlyhave,hol dandenjoysaidPremisesforthetermhereof.
20. INDEMNIFICATION.  Landlord shall not be liable for any damage or injury of or to theTenant, Tenant’s family, guests,
invitees,agentsoremployeesortoanypersonen teringthePremisesorthebuildingofwhichthePremisesareapartortogoods
or equipment,orinthestructureor equipmentof t hestructureof whichthePremisesareapart,andTenanthereby a greesto
indemnify,defendandhol dLandlord harmlessfromanyandallclaimsorassertionsofeverykindandnature.
21. DEFAULT.If Tenantfailstocomplywithanyofthem aterialprovisionsof thisAgreement,otherthanthecovenanttopayrent,
orofanypresentr ulesandregulationsoran ythatma ybehereafter prescribedby Landlord, ormateriallyfailstocomplywithany
duties imposed on Tenant by statute, within seven (7) days aft er delivery of written notice by Landlord specifying the non
com plian ce and indicating the intention of Landlord to terminate the Lease by reason thereof,  Landlord m ay terminate this
Agreement. If Tenant fails to pay rent when due and the default continues for seven (7) days thereafter, Landlord may, at
Landlord’soption,declaretheentirebalanceofrentpayablehereunder tobeimmediatelydueandpayableandmayexerciseany
andallrightsandremediesava ilableto Landlord atlaworinequityormayimmediatelyterminatethisAgreement.
22. LATECHARGE. Intheeventthatanypaymentrequiredt obepaidbyTenanthereunderisnotmadewithinfive(5)ca lendar
daysofwhendue,TenantshallpaytoLandlord, inadditiontosuchpaymentorotherchargesduehereunder,a“latefee”inthe

23. ABANDONMENT.  If at any time during th e term of this Agreement Tenant abandons the Premises or any part thereof,
Landlordmay, atLandlord’soption,obtainpossessionofthePremisesinthemanner providedbylaw,a nd withoutbecoming
liabletoTenan tfordamagesorfor anypaymentofanykindwhatever. Landlordmay, a tLandlord’sdiscretion,asagentfor
Tenant,reletthePremises,oranypartth ereof,forthewholeoranypartth ereof,forthewholeoranypartofthethenunexpired
term, andmayreceiveandcollectallrentpayablebyvirtueofsuchreletting,and,atLandlord’soption,holdTenant liableforany
differencebetweentherentthatwouldhavebeenpayableunderthisAgreementduringthebalanceoftheunexpiredt erm,ifthis
Agreementhadcontinuedinforce,andthenetrentforsuchperiodrealized by Landlordbymeans of such reletting.If Landlord’s
right of reentry is exercised following abandonment of the Pr emi ses by Tenant, then Landlord shall consider any per sonal
propertybelongingtoTenantandleftonthePremisestoalsohavebeenabandoned,inwhichcaseLandlordmaydisposeofall
suchpersonalpropertyinanymannerLandlordshalldeemproperandLandlord i sherebyrelievedofallliabilityfor doingso.

24. ATTORNEYS’ FEES.  Should it become necessary for Landlord to employ an attorney to enforce any of the conditions or
covenantshereof,includingthecollectionofrentalsorgainingpossessionofthePremises, Tenantagreestopayallexpensesso
incurred,includingareasonableattorneys’fee.
25. RECORDINGOFAGREEMENT. T enantshall notrecordthisAgreementonthePublicRecordsofanypubl icoffice.Inthe
eventthatTenantshallrecordthisAgreement,thisAgreementshall,atLandlord’soption,terminateimmediatelyandLandlord
shallbeentitledtoallrightsandremediesthatithasatlaworinequity.
26. GOVERNINGLAW.ThisAgreementshallbegoverned,construedandinterpretedby,throughandundertheLawsof the State 
of NorthCarol ina.
27. SEVERAB ILITY. If any provision of thi s Agreement or the appl ication thereof shal l, for any reason and to a ny ext ent, be
invalidorunenforceable,neithertheremainderofthisAgreementnortheapplicationoftheprovisiontootherpersons,entitiesor
circumstancesshallbeaffectedthereby,butinsteadshallbeen forcedt othemaximum extentpermittedbyl aw.
28. BINDINGEFFECT.Thecovenants,obl igationsandconditionshereincontainedshallbebindingonandinuretoth ebenefitof
theheirs,legalrepresentatives,andassignsofthe partieshereto.
29. DESCRIPTIVE HEADINGS. Th e descript ive headings used hereinare for convenience of reference only andthey are not
intendedtohaveanyeffectwhatsoeverindeterminingtherightsorobligationsof the Landlord orTenant.
30. CONSTRUCTION.Thepronounsusedhereinshallinclude,whereappropriate,eithergender orboth,singularandplural.
31. NONWAIVER.Noin dulgence,waiver,electionornonelectionby LandlordunderthisAgreementshallaffectTenant’sduties
andliabi litieshereunder.
32. MODIFICATION. The parties hereby agree that this document contains the entire agreement betwe en the parties and this
Agreementsha llnotbemodified,changed,a lteredoramendedinanywayexceptthroughawrittenamendmentsignedbyallof
thepartieshereto.
33. NOTICE.AnynoticerequiredorpermittedunderthisLeaseorunderstatelawshallbedeemedsufficien tlygivenorservedif
sentbyUnitedStatescertifiedmail,returnreceiptrequested,addressedasfollows:
