THIS INDENTURE, made this 3
rd
day of December, 2015, A.D. between the State of
Oklahoma, ex rel., Oklahoma Department of Transportation, party of the first part, and BNSF
Railway Company, a Delaware corporation, party of the second part,
WITNESSETH: That said party of the first part, in consideration of the sum of Ten and
No/100 Dollars ($10.00) and other valuable consideration to it in hand paid, the receipt of which is
hereby acknowledged, except for and subject to any existing utility easements, licenses or permits
and subject to the use as railroad right-of-way and the reservations, conditions and
exceptions made hereinafter
Railway Company, a Delaware corporation, Mailing Address: 2301 Lou Menk Drive, GOB-3W,
Fort Worth, TX, 76131, party of the second part, all its rights, title, interest, estate, and every claim
and demand, both at law and in equity, in and to all the following described property, to-wit:
A strip, piece or parcel of land lying in part of Lots 13 thru 15, Block 18, West Tulsa
addition and Lots 14 thru 22, Block 1, and Lots 16 thru 24, Block 2, and Lots 19 thru
25, Block 3, and Lots 21 thru 23, Lots 25 thru 29, Block 6, Riverside Addition to West
Tulsa, of the Original Townsite of Tulsa, according to the recorded plats thereof, and
part of the SW¼ of Section 11, T19N, R12E in Tulsa County, Oklahoma. Said parcel
of land being described by metes and bounds as follows:
Beginning at a point 683.01’ East of the Southwest Corner of the Southwest Quarter
(SW/4) of Section Eleven (11) on the present West right-of-way line of U.S. Highway
No. 244; Thence N 08°34’13” E and along said right-of-way line a distance of 6.90’ to
a point; Thence N 08°36’12” E along said right-of-way line a distance of 686.59’ to a
point; Thence N 08°35’01” E along said right-of-way line a distance of 595.56’ to a
point; Thence S 81°20’27” E and away from said right-of-way line a distance of
30.88’ to a point; Thence S 08°34’35” W a distance of 398.20’ to a point; Thence
S 03°55’37” W a distance of 702.48’ to a point; Thence S 07°07’48” W a distance of
175.11’ to a point on the South Line of the Southwest Quarter (SW/4) of Section
Eleven (11); Thence S 89°01’34” W and along the South Line of the Southwest
Quarter (SW/4) a distance of 93.94’ to the point of beginning.
Containing 1.62 acres, more or less.
Grantor, reserves and excepts unto itself, its successors and assigns
ALL RIGHTS
from said 1.62 acres, more or less to the lands or
rights-of-way covered by the abutting Interstate Highway No. 244
Limited Access
Highway facility along the East sides of the above described property, also, Grantor
reserves and excepts, unto itself, its successors and assigns a PERPETUAL
MAINTENANCE EASEMENT upon, over, and across the said parcel of land being
described by metes and bounds as follows:
A strip, piece or parcel of land lying in part of Lots 24 thru 25, Block 3, and Lots 21,
22, 27 thru 29, Block 6, Riverside Addition to West Tulsa, of the Original Townsite of
Tulsa, according to the recorded plats thereof, in Tulsa County, Oklahoma. Said
strip, piece, or parcel of land being described as follows to-wit:
Beginning at a point 21.81’ South and 16.22’ West of the Northeast Corner of said
Lot 25, Block 3, West Tulsa Addition; Thence S 03°55’57” W distance of 295.91’ to a
point; Thence S 07°07’48” W a distance of 199.27’ to a point; Thence N 81°23’21” W
a distance of 30.00’ to a point; Thence N 08°41’26” E a distance of 494.12’ to the
point of beginning.
Containing 0.21 acres, more or less.
This perpetual easement is granted for the sole purpose of enabling the Grantor, its
officers, agents, employees, contractors, permitees and assigns to go upon, survey,
locate, construct, reconstruct, build and maintain a Retaining Wall and all necessary
or convenient appurtenances thereto, and includes the permanent right of ingress
and egress by the Grantor, its officers, agents, employees, contractors, permitees
and assigns as established by Conveyance and Easement agreement between
the
State of Oklahoma, ex rel., Oklahoma Department of Transportation
and
BNSF Railway Company, a Delaware corporation
dated

PURSUANT TO: the stipulations and condition established in the Conveyance and
Easement Agreement between
the State of Oklahoma, ex rel., Oklahoma
Department of Transportation
and
BNSF Railway Company, a Delaware
corporation dated day of , 2015.
together with all and singular the hereditaments and appurtenances thereunto belonging.
SUBJECT HOWEVER, to 23 CFR 710.409(d), that in the event the party of the
second part, the
BNSF Railway Company, a Delaware corporation
, of the herein described
tract of land, fails to continue ownership and use of said tract, ownership shall revert to the
party of the first part, the State of Oklahoma, ex rel., Oklahoma Department of
Transportation, or its assigns, free and clear of any claims of the party of the second part,
and;
TO HAVE AND TO HOLD the above described premises unto the said party of the
second part, their heirs, successors and assigns forever, so that neither it, the said State
of Oklahoma, ex rel., Oklahoma Department of Transportation or any person in its name
and behalf, shall or will hereafter claim or demand any right or title to the said premises or
any part thereof; but they and everyone of them shall by these presents be excluded and
forever barred and said premises shall be subject to the rights of any existing utility
easements, licenses or permits which may presently be occupying said right-of-way. The
intent of this instrument is to convey any and all of the State of Oklahoma, ex rel.,
Oklahoma Department of Transportation’s rights, title and interest and subject to the use
as railroad right-of-way and the reservations and exceptions above stated herein.
