Simple Copyright Release Form

For good and valuable consideration the exchange of which is hereby acknowledged, I

grant The American Institute of Architects (“AIA”) a non-exclusive license to use my

copyrighted Work, including any text, brochures, drawings, photographs, graphics, plans,

slides, books, transparencies or other copyrightable material (the “Work”) identified on

page 2 of this form and submitted in connection with the 2010 AIA Edward C. Kemper

Award.

This license shall include the right to use, modify, reproduce, publicly display, distribute

and transmit worldwide the Work during the full term of the copyright in all media, now

known or hereafter devised, including the Internet, without payment of any royalty or

license fee, as follows:

• In connection with the announcement of any awards under the awards program and

the promotion of the awards program itself;

• In connection with the AIA’s efforts to educate architects, other professionals, and the

public about architecture, the AIA, or any m atter pertaining to the AIA’s corporate

purpose, goals or mission, through various media, including, but not limited to paper,

electronic, video, audio, or other media wh ether or not now known, invented, used or

contemplated.

I acknowledge that all copies of the Works submitted in connection with any entry shall

remain the property of the AIA. The AIA agrees to include in reproductions of the

Works a reasonable copyright notice and credits provided that the necessary copyright

and credit information is noted below.

By submitting this Copyright Release Form, I represent that I have obtained all

permissions necessary to grant the rights granted by this form and that use or

reproduction of the Work by AIA, as permitted by this Copyright Release Form , shall not

infringe or violate any copyright, trademarks, trade secrets, rights of privacy or any other

statuary or common law proprietary or other rights.

I agree that any royalties or license fee charged for use of this Work shall be paid by the

Entrant and not the AIA.

I AGREE TO INDEMNIFY AND HOLD HARMLESS AIA FROM AND

AGAINST ALL CLAIMS OR DAMAGES ARISING OUT OF ANY BREACH OF

THESE REPRESENTATIONS OR ANY THIRD-PARTY CLAIMS RELATING

THEREOF.

Information and illustrations for a project receiving an award or chosen for inclusion in

any award citation will be taken from the information and materials submitted by the

Entrant. There may be no further communication with an Entrant prior to the

announcement of an award. Accuracy, therefore, is essential.

BY MAKING A SUBMISSION, THE ENTRANT AGREES THAT THE

INFORMATION OR MATERIALS SUBMITTED BY THE ENTRANT ARE

COMPLETE AND ACCURATE. THE ENTRANT FURTHER AGREES TH AT

IT SHALL INDEMNIFY AND HOLD HARMLESS The American Institute of

Architects (“AIA”) FROM AND AGAINST ALL CLAIMS OR DAMAGES

ARISING OUT OF THE USE OF ANY INFORMATION OR OTHER

MATERIALS SUPPLIED BY THE ENTRANT. ALL ERRORS OR OMISSIONS

ARE THE SOLE RESPONSIBILITY OF THE ENTRANT.

The Entrant further ce rtifies that:

(1) it has obtained all permissions, as evidenced by the signatures below, necessary to

permit AIA to use and publish any information, Work or other materials submitted by

the Entrant in connection with the award, including from any individual, client,

architect, contractor or copyright owner.

(2) it has enclosed with its submission a copy of AIA’s Copyright Release Form signed

by the copyright owner(s) of any copyrightable material, including text, drawings,

photographs, graphics, plans, slides, books, transparencies and brochures (the

“Work”), granting AIA permission to use the Work as it deems appropriate in

connection with this awards program, including publicizing the program itself. If a

Work is owned by more than one copyright owner, each copyright owner must sign a

separate AIA Copyright Release Form. AIA will only accept an AIA Copyright

Release Form signed by the copyright owner(s)

(3) it has obtained permission for AIA to use the Works without financial or other

obligation and will pay any licensing fees or royalties charged by the copyright

owner.

FAILURE TO COMPLY WITH ANY OF THE ABOVE REQUIREMENTS MAY

RESULT IN YOUR SUBMISSION BEING INELIGIBLE TO BE CONSIDERED
