VIDEOGRAPHER RELEASE AGREEMENT
Work for Hire and Copyright Assignment
In consideration of Recruit Reels, Inc. (hereinafter referred to as “Company”) engaging
________________________________ (hereinafter referred to as “Videographer”) to videotape
certain content for the Company, and in consideration of ____________ (amount) and other good and
valuable consideration _______________ , the receipt of which Videographer acknowledges,
Videographer agrees as follows:
1.
All copyrightable works (including, but not limited to all recorded video regardless of how
such works are recorded) that Videographer records at the request and direction of the
Company or otherwise for the benefit of the Company shall be and are “works made for hire”
under federal copyright law.
2.
Videographer assigns to the Company any rights (including copyrights and other intellectual
property rights) that Videographer may have or obtain in all copyrightable works that
Videographer records and has recorded at the request or direction of the Company.
Videographer agrees that at any time at the request of the Company, Videographer will
promptly execute and deliver all further instruments and documents and take all further action,
that may be necessary or desirable, to confirm and complete such assignment granted
hereunder.
3.
Videographer shall not use any person to create works for the Company who does not agree
beforehand, in writing: (1) that the works are to be “works made for hire” under federal
copyright laws and (2) to assign to the Company all rights the person may have or obtain in
the works. Videographer shall provide the Company with copies of all such “work for hire”
and assignment agreements before any person participates in the creation of any copyrightable
work for the Company.
4.
Upon completion of any work product for the Company, Videographer shall promptly deliver
copies of the work product to Company in such reasonable form as requested by the
Company. Thereafter, upon request by the Company and at the Company’s expense,
Videographer shall promptly deliver copies of any work product to the Company in form as
requested by the Company.
5.
During and after the expiration or termination of this agreement, Videographer and their agents
agree not to compete with Company for a period of 1 (one) year by not pursuing any of
Company’s existing clients, and/or documented potential clients. Competition means owning
or working in the field of video highlight reels for a Company client and/or documented
potential client.
6.
Videographer agrees to hold harmless Company for any personal injury or damage to
equipment sustained in the performance of duties for which Videographer is an independent
contractor.
