MONTH-TO-MONTH RENTAL AGREEMENT
THISLEASE AGREEMENT(hereinafter referred to asthe “Agreement”) made and entered into this ____________dayof

WHEREAS, Landlord desiresto lease the Premisesto Tenant upon the terms and conditions as contained herein; and

NOW, THEREFORE, for and in consideration of the covenants and obligations contained herein and other good and valuable
consideration, the receipt andsufficiency of which is herebyacknowledged, the parties hereto hereby agree as follows:
1.TERM. This Agreement shall commence on ________________________ (“Commencement Date”). [check either A or B]:

terminate the tenancy, Tenant maydo so byproviding to Landlordwrittennotice ofintention to terminate. Such notice to
terminatemust be provided to Landlord at least 30 daysprior to the desired date ofterminationof the tenancy. If at anytime
Landlord desires to terminate the tenancy, Landlord maydo so byproviding toTenant such written noticeofintention to
terminateat least 30days prior to the desired date of termination of the tenancy.Notices to terminate maybegiven on any
calendar day, irrespective of Commencement Date.

at 11:59PM. Upon terminationdate,Tenantshallbe required to vacatethe Premises unlessone of the following circumstances
occur: (i) LandlordandTenant formallyextend this Agreementinwriting or createand execute a new, written, and signed
agreement; (ii) local rentcontrollaw mandates extension of the tenancy;or (iii) Landlord willinglyaccepts new Rentfrom
Tenant, whichdoes not constitutepastdue Rent. In the event that Landlord acceptsfrom Tenant newrent, a month-to-month
tenancyshall be created.Either partymay terminate this month-to-month tenancyby followingthe proceduresspecifiedin
paragraph1A.Rent shall continueat the rate specified in this Agreement, or as allowed by law. All other terms and conditions as
outlined in this Agreement shall remain in fullforce and effect.
2.RENT. Under the terms of this Agreement,“Rentshall consistof all monetaryobligations owed toLandlord by Tenantin
accordancewiththis Agreement.However,the Damage Deposit shall not be considered Rent. Tenantshallpayto Landlord

3.SECURITY DEPOSIT. Upon thedue execution of this Agreement, Tenant shalldeposit with Landlord the sum of

Suchdeposit shallbe returned to Tenant, withoutinterest, and less anyset off for damagestothe Premises upon the termination
of this Agreement.
Landlord willhold Tenant’s security deposit in an account in the following Florida banking institution: ____________________
_____________________________________________________.Landlord will not commingle the securitydeposit funds with
those fundsinthe Landlord’s primarybank account. Rather, Landlord willmaintain the security deposit funds ina separate non-
interest bearing account forthe benefit of the Tenant. Accordingly, Tenant will NOT receive any intereston the securitydeposit.
In accordance with Florida law (Florida Statute Section 83.49),Landlord is required toinclude inTenant’s lease thefollowing
provisions regarding return of security deposits. Florida Statute Section 83.49(3):
(a) Upon the vacating of the premises for termination of the lease, if the landlord does not intend toimpose a claim on the security
deposit, the landlord shallhave 15days to returnthe securitydeposit togetherwith interest if otherwise required, or the landlord
shallhave 30daysto give the tenantwritten notice bycertified mailto the tenant’slastknow mailing addressof his orher
intention to impose a claim on the depositand thereason for imposing theclaim.The notice shall contain a statement in
substantiallythe following form: This is a notice of my intention to impose a claim for damages in the amount of
$_____________ upon Tenant’s security deposit, due to_________________________________________. It issent to youas
requiredby s.83.49(3), FloridaStatutes. You are herebynotified thatyou must object in writing to thisdeductionfrom you
security deposit within 15 daysfrom the time you receive this notice or I will be authorized to deduct my claim from your security
deposit. Tenant’s objection must be sent to (landlord’s address). If the landlord fails to give the required notice within the 30-day
period, he or she forfeits the right toimpose a claim uponthe securitydeposit.
(b) Unlessthe tenant objects to theimposition of thelandlord’s claim or the amount thereof within 15 days after receipt of the
landlord’s notice of intention to impose a claim, thelandlord maythen deductthe amountof his or her claim and shall remit the
balance of the depositto the tenant within 30 days after the date of the notice of intentionto impose a claim for damages.
(c)Ifeither partyinstitutes an action in a court ofcompetentjurisdictionto adjudicate the party’s right to the securitydeposit, the
prevailing partyisentitled to receive his orhercourt costs plusa reasonablefee for his or her attorney. The court shall advance
the causeon the calendar.
(d) Compliance withthissection byan individual orbusiness entity authorizedto conductbusiness inthisstate,including Florida-
licensed realestate brokers andsales associates, shallconstitute compliance with all other relevant Florida Statutes pertaining to
securitydeposits held pursuant to a rentalagreement or other landlord-tenant relationship.Enforcementpersonnel shalllook
solelytothis sectiontodetermine compliance. Thissection prevailsover anyconflicting provisions inchapter 475an in other
sections of the Florida Statutes, and shalloperate to permitlicensed real estate brokers to disburse securitydeposits and deposit
money without having to complywith the notice andsettlement procedures contained in s.475.25(1)(d).
4.USE OF PREMISES. The Premises shall be used and occupied byTenant and Tenant’simmediate family,consistingof
___________________________________________________________________________________, exclusively,as aprivate
single familydwelling, and no part of the Premises shallbe used atanytime during the term of thisAgreement byTenantfor the
purpose of carrying on anybusiness,profession,or trade of anykind, orfor anypurpose otherthan as aprivatesingle family
dwelling. Tenant shall notallow anyotherperson, other than Tenant’s immediate family or transientrelatives and friendswho
are guestsofTenant, to use or occupythe Premiseswithout first obtaining Landlord’swrittenconsent tosuch use. Tenant shall
complywithanyand all laws, ordinances, rulesand orders of anyand allgovernmental or quasi-governmental authorities
affecting the cleanliness, use, occupancy and preservation of the Premises.
5.CONDITION OF PREMISES. Tenant stipulates, represents and warrants that Tenanthas examined the Premises, and that they
are at the time of this Lease in good order, repair, and in a safe, clean and tenantable condition.
6.ASSIGNMENT ANDSUB-LETTING.Tenantshall notassign this Agreement,or sub-letor grantanylicense to use the
Premises or anypartthereof without the prior written consentof Landlord. AconsentbyLandlordto one suchassignment,sub-
lettingor license shall not be deemed to be a consent to anysubsequent assignment, sub-letting or license.An assignment, sub-
lettingor license withoutthe prior written consentof Landlordor an assignmentor sub-letting byoperation of law shall be
absolutely null and void and shall, at Landlord’s option, terminate this Agreement.
7.ALTERATIONS AND IMPROVEMENTS. Tenant shall make no alterations to the buildings or improvements onthe Premises
or construct anybuilding or make any other improvements on the Premiseswithoutthe prior written consent ofLandlord. Any
andallalterations, changes, and/or improvements built,constructed or placed on the Premises byTenantshall,unless otherwise
provided bywritten agreement between Landlord and Tenant,be and become the propertyofLandlord andremain on the
Premises at the expiration or earlier termination of this Agreement.

8.NON-DELIVERY OFPOSSESSION. IntheeventLandlordcannot deliver possession of the Premises toTenant upon the
commencement of theLease term,through no faultof Landlordorits agents, then Landlord or its agents shall have noliability,
but the rental herein provided shallabate untilpossessionis given. Landlordor itsagents shallhave thirty(30)daysin which to
give possession, and if possession is tendered within such time, Tenant agrees to accept the demised Premises andpaythe rental
herein provided from that date. Inthe event possession cannotbe deliveredwithin such time, through no fault ofLandlord or its
agents, then this Agreement and all rights hereunder shall terminate.
9.HAZARDOUS MATERIALS. Tenant shallnot keep onthe Premises anyitemof a dangerous, flammable orexplosive
character thatmight unreasonablyincrease the dangerof fire or explosion on the Premises or that might be consideredhazardous
or extra hazardous by any responsible insurance company.
10.UTILITIES. Tenantshall be responsible for arranging for and paying for all utilityservices required on the Premises.
11.MAINTENANCE AND REPAIR; RULES. Tenant will,at its soleexpense, keep and maintain the Premises and appurtenances
in good andsanitarycondition and repairduring the term of this Agreementand anyrenewal thereof.Withoutlimiting the
generalityof the foregoing, Tenant shall:
(a)Notobstruct the driveways, sidewalks, courts,entry ways, stairs and/or halls,which shall beused for the purposes of ingress
and egress only;
(b)Keep all windows,glass, window coverings,doors, locks and hardware in good, clean order and repair;
(c)Not obstruct or cover the windows or doors;
(d)Not leave windows or doors in an open position during anyinclement weather;
(e)Nothang anylaundry,clothing, sheets, etc. from anywindow, rail,porchor balconynor air ordryanyof same within any
yard area or space;
(f)Not cause or permit any locks or hooks to be placedupon any door or window without the prior written consent of Landlord;
(g)Keep all air conditioning filters clean and free from dirt;
(h)Keep all lavatories, sinks, toilets,and allother waterand plumbingapparatus ingood order and repair and shall use same
onlyfor thepurposes for which theywere constructed. Tenant shall not allowanysweepings, rubbish,sand, rags, ashes or
othersubstancesto be thrown or deposited therein. Anydamage to anysuchapparatusand thecostof clearing stopped
plumbing resulting from misuse shall be borneby Tenant;
(i)And Tenant’sfamilyand guests shallat all times maintainorder in the Premisesand at all places on the Premises, and shall
not make or permit anyloud or improper noises, or otherwise disturb other residents;
(j)Keepall radios,television sets, stereos, phonographs, etc., turned down toa level of sound that does not annoyor interfere
with other residents;
(k)Deposit all trash, garbage, rubbish or refuse in the locations provided andshall not allow anytrash, garbage, rubbish or refuse
to be deposited or permitted to stand on the exterior of any building or within the commonelements;
(l)Abide byand be bound byanyand all rules and regulations affectingthe Premises or the common area appurtenant thereto
which maybe adopted or promulgated by the Condominium or Homeowners’ Association having control over them.
12.INSURANCE.Landlord, Landlord’s agentor manager, or, if applicable, the Condominium or Homeowners’ Association, are
not responsible for insuring Tenant’s or Tenant’s permitted visitors’personal propertyandvehicles against loss ordamage due to
theft, vandalism, fire, water, rain, criminal or negligent actsof others, or any other cause. Landlord has advised Tenant to carry
Tenant’s own insurance (renter’s insurance) to protect Tenant fromany such lossor damage. The parties agree that, upon
notification byLandlord, Tenant shall take allactions necessaryto avoid: (i)an increaseinLandlord’sinsurance premium (or
Tenant shall payfor the increase in premium); or (ii) loss ofinsurance.
13.DAMAGE TO PREMISES. Inthe event the Premises are destroyed orrendered whollyuninhabitable byfire,storm,
earthquake, orother casualtynot caused bythe negligence of Tenant, this Agreement shall terminate from such time exceptfor
the purpose of enforcing rights that may have thenaccruedhereunder. The rentalprovided for herein shallthenbe accountedfor
byand between Landlordand Tenant up to the time of such injuryor destructionof thePremises, Tenant paying rentals upto
such date and Landlord refunding rentals collected beyondsuch date. Should a portionof the Premises therebybe rendered
uninhabitable, the Landlord shall have the option of either repairing such injured or damaged portion or terminating this Lease. In
the eventthatLandlord exercises its righttorepair such uninhabitable portion, the rental shall abate inthe proportion thatthe
injured parts bears to thewhole Premises, and such partso injured shall be restored byLandlord asspeedilyas practicable,after
which the fullrent shall recommence and the Agreement continue according toits terms.
14.INSPECTION OFPREMISES. Landlord and Landlord’sagentsshall have the rightatallreasonable times during the term of
thisAgreement andanyrenewalthereof toenter the Premises for the purpose of inspecting the Premises and all buildingsand
improvementsthereon. And for the purposes of making any repairs, additions oralterationsasmaybe deemed appropriate by
Landlord for the preservation of the Premises or the building. Landlord andits agentsshallfurther have the rightto exhibit the

Premises and to displaythe usual “for sale”,“for rent” or “vacancysigns on the Premises at anytime withinforty-five (45) days
before the expirationof thisLease. The right of entryshall likewise existfor thepurpose ofremovingplacards,signs,fixtures,
alterations, or additions that do not conform tothis Agreement or to anyrestrictions, rules or regulations affecting thePremises.
15.SUBORDINATION OF LEASE. ThisAgreement and Tenant’s interest are andshallbe subordinate, junior and inferior toany
and all mortgages, liens or encumbrances now or hereafter placed on the Premises byLandlord, all advances made under any such
mortgages, liens or encumbrances (including, but not limited to, future advances), the interest payable on such mortgages, liens or
encumbrances and any and all renewals, extensions or modifications of such mortgages, liens or encumbrances.
16.TENANT’SHOLD OVER.If Tenant remainsinpossession of the Premises with the consent of Landlord afterthe natural
expirationof this Agreement,a new tenancyfrommonth-to-month shallbecreatedbetween Landlord and Tenantwhich shallbe
subjectto allof the terms and conditionshereof except that rentshall thenbe due andowing at___________________________

such tenancy shallbe terminable upon thirty (30) days written notice served by either party.
17.SURRENDER OF PREMISES. Upon the expiration of the term hereof, Tenant shall surrender the Premises in as good a state
and condition as theywere at the commencement of this Agreement, reasonable use and wear and tear thereof and damages by the
elements excepted.
18.ANIMALS. Tenant shall be entitled to keep no more than ____________ (_____) domestic dogs, cats or birds; however, atsuch

performance of all Tenant’s agreements contained hereinand Tenant’s observance of all rules and regulations,shall and may
peacefully and quietly have, hold and enjoysaid Premises for the term hereof.
20.INDEMNIFICATION. LANDLORD SHALL NOT BE LIABLE FOR ANYDAMAGE OR INJURY OF OR TO THE
TENANT, TENANT’SFAMILY, GUESTS, INVITEES, AGENTS OR EMPLOYEES OR TO ANYOTHER PERSON
ENTERING THE PREMISES OR ANY BUILDING THAT IS A PART OR LIES UPON THE PREMISES, OR TO GOODS OR
EQUIPMENT, OR INTHE STRUCTURE OR EQUIPMENT OF THESTRUCTURE OF WHICH THEPREMISES AREA
PART, AND TENANT HEREBY AGREES TO INDEMNIFY, DEFEND AND HOLD LANDLORD HARMLESSFROM ANY
AND ALLCLAIMS OR ASSERTIONS OF EVERY KIND AND NATURE. THIS INDEMNIFICATION INCLUDES,BUTIS
NOT LIMITED TO,ANY DAMAGEOR INJURY WHICH MAY BE INCURRED BY TENANT, TENANT’S FAMILY,
GUESTS, INVITEES, AGENTS OR EMPLOYEES OR TO ANY OTHER PERSON FOR DAMAGE ORINJURIES THAT
ARISEFROM ANY CONTACT, ATTACK OR INTERACTION FROM OR WITH ANY ANIMALS, DOMESTIC OR WILD,
WHETHERSUCH DAMAGE ORINJURY OCCURS ON THE PREMISES OR OFF, AND TENANTHOLDS HARMLESS
THE LANDLORD FROM ANY AND ALL CLAIMS OR ASSERTIONS OF EVERY KIND AND NATUREFOR ANY
DAMAGEOR INJURYTENANT ATTRIBUTESTO ANY ABSENCE OR FAILURE OF FENCING THAT MAY BE ON OR
SURROUNDING THE PREMISES.
21.DEFAULT.If Landlord determines that the Tenantis in default ofthis Agreement, Landlordshallprovide Tenant with a notice
of default, and Tenant shall have a limitednumber of daystocure the default unless otherwiseexcepted: (a) for the failure to pay
rentwhendue, Tenantshallhave three (3) daysto cure; (b) for activities in contravention of thisAgreement (includingbutnot
limited to having or permitting unauthorizedpets, guests, or vehicles; parking inanunauthorized mannerorpermitting such
parking;or failing to keepthe premises clean and sanitary), the Tenantshall have seven (7) days to cure. If Tenant fails tocure
the default within the required time frame, Landlord mayimmediatelyterminate thisAgreement, andTenantshall immediately
vacate the Premises andshallreturn the keysto Landlord. However, if Tenant’s default isof a naturethatTenant should notbe
given an opportunityto curethe default(including butnot limitedtodestruction,damage, ormisuseof Landlord's orother
tenants'propertybyintentionalact or a subsequent orcontinued unreasonable disturbance), or if the defaultconstitutes a
subsequentor continuing default withintwelve (12) monthsof a written warning byLandlord of a similar violation, Landlord
maydeliver a written notice to Tenantspecifying the default and Landlord's intent toterminatethis Agreement. In such event,
Landlord mayterminate thisAgreement, and Tenantshall have seven (7) daysfrom the date that thenotice isdeliveredto vacate
the premises. In addition, if this Agreementis terminated pursuant to thisparagraph, Landlord may, at Landlord's option, declare
the entire balance of rentpayable hereunder to be immediatelydue and payable and mayexercise anyand allrights and remedies
available to Landlord atlaw or in equity.

22.LATE CHARGE. In the eventthatanypaymentrequired to be paidbyTenant hereunder is notmade within three (3) daysof
whendue, Tenant shall paytoLandlord, in addition to such payment or other charges due hereunder, a“late fee” in the amount of

23.ABANDONMENT. If at anytime duringthe term ofthisAgreementTenantabandonsthe Premises oranypartthereof,
Landlord may,at Landlord’s option,obtain possession of the Premises in the manner provided bylaw, andwithoutbecoming
liable to Tenantfor damages or for anypayment ofanykindwhatever.Landlordmay, atLandlords discretion,as agent for
Tenant, reletthe Premises, or anypartthereof, for the whole oranypartthereof, for thewhole or anypart of the then unexpired
term, and mayreceive and collect all rent payable byvirtue ofsuch reletting, and, at Landlord’s option, hold Tenant liable for any
difference between the rent thatwouldhave been payable under this Agreement during the balance of the unexpired term, if this
Agreement had continued in force, and the net rent for suchperiod realized byLandlord by means of such reletting. If Landlord’s
rightof reentryis exercisedfollowing abandonment of the PremisesbyTenant, then Landlordshall consider anypersonal
propertybelonging to Tenantand left on the Premises to alsohave been abandoned, inwhich case Landlord maydispose of all
such personalpropertyin any manner Landlord shalldeem properandLandlord is hereby relieved of allliabilityfor doing so.
BY SIGNING THIS AGREEMENT,TENANT AGREESTHAT UPON SURRENDER OR ABANDONMENT, AS DEFINED
BY CHAPTER 83,FLORIDA STATUTES, LANDLORD SHALL NOT BE LIABLE OR RESPONSIBLE FOR STORAGE OR
DISPOSITION OF THE TENANT’S PERSONAL PROPERTY.
24.ATTORNEYS’FEES.Should it become necessary forLandlord to employan attorneytoenforce any of the conditions or
covenants hereof, including thecollection of rentalsorgaining possession of the Premises,Tenantagreesto payallexpenses so
incurred, including a reasonable attorneys’ fee.
25.RECORDING OF AGREEMENT. Tenant shall not record thisAgreement on thePublic Records of anypublic office. In the
eventthat Tenant shall record this Agreement, this Agreementshall,at Landlord’s option, terminate immediatelyandLandlord
shall be entitled to all rights and remedies that it has at law or in equity.
26.GOVERNING LAW. This Agreement shall be governed, construed and interpreted by, through and under the Laws of Florida.
27.SEVERABILITY. If anyprovision of this Agreementor the application thereof shall,for any reason and to anyextent, be
invalid or unenforceable, neither the remainder of this Agreementnor the application of the provision to other persons,entities or
circumstances shall be affected thereby, but instead shall be enforced to the maximum extent permitted by law.
28.BINDING EFFECT. The covenants, obligations and conditions herein contained shallbe binding onandinureto the benefitof
the heirs, legal representatives, and assigns of the parties hereto.
29.DESCRIPTIVE HEADINGS. The descriptive headings used hereinarefor convenience of reference onlyand theyare not
intended to have any effect whatsoever in determining the rightsor obligations ofthe Landlordor Tenant.
30.CONSTRUCTION. The pronouns used herein shall include, where appropriate, either gender or both,singular and plural.
31.NON-WAIVER. No indulgence, waiver, election or non-election byLandlord underthis Agreementshall affect Tenant’s duties
andliabilities hereunder.
32.MODIFICATION. The parties herebyagree that this document contains the entire agreement betweenthe parties and this
Agreement shall notbe modified, changed, altered or amendedinanywayexcept through a written amendment signed by allof
the parties hereto.
33.WAIVER OFJURY TRIAL. LANDLORD AND TENANT HAVE SPECIFICALLY WAIVEDTHE RIGHTTO A JURY
TRIAL CONCERNING ANYDISPUTES WHICH MAY ARISE CONCERNING THIS AGREEMENT, SPECIFICALLY BUT
NOT LIMITED TO, ANY ISSUES INVOLVING TENANT’S TENANCY.
34.RADON NOTIFICATION.Pursuant to Florida Statute 404.056(8),Tenant is notified:“RADONGAS: Radonisa naturally
occurringradioactive gas that,when it has accumulated in the building in sufficient quantities, maypresent health risks to persons
who are exposed to it over time. Levels of radon gasthat exceed federaland state guidelines have beenfound in buildings in
