Definition ofan Abandoned Motor Vehicle under Alabama Law
section32-13-1, Code of Alabama 1975,definesan abandoned motor vehicle* as follows:
(
1) Whichhasbeen left by the owner, or some person acting for the owner, with an automobiledealer, repairmanor
wreckerservice for repairor for someother reasonandhasnot been called for by the owner or otherperson within a
period of 60days afterthetime agreed upon and within 60 days after the vehicle isturnedover toa dealer, repairman
or wrecker service when no time is agreedupon, or within60 days afterthecompletionof necessaryrepairs.
(2)Which is left unattended ona public street, road, or highway or other public property for a period of atleast seven
days; or whichis unattended because the driver of the vehicle has been arrested or isimpaired by anaccident which
causes the needforthevehicletobe immediately removed asdeterminednecessary by the law enforcement officer, or
which is subject to animpoundment order for outstanding traffic or parking violations; or left unattended
continuously for at least sevendays in a business districtor a residence district; orif left unattended in a business
district that has at least one posted notice inan open and conspicuous placeindicatingthat there is a time limitation on
thelength of time a motor vehicle may remainparkedin the districtandthemotor vehicle remainsunattendedfora
period of time in excessof that posted onthenotice; orleft unattended ina business district or residence districtthat
hasat leastonepostednotice indicating that only authorized motorvehicles may park in that districtandtheowner of
themotor vehicle or his orheragent has not received the required authority priorto leaving the motorvehicle
unattended;orleft unattended ona private road or driveway without the express or implied permission oftheowner
or lessee ofthe driveway or theiragent. A posted noticewhen required by this chapter shall meet the following
specifications:
a. the notice shallbe prominently placed at each drivewayaccess or curb cut allowing vehicularaccessto the
property, within five feet from the public right-of-way line.if thereareno curbsor access barriers,thesigns
must bepostednotless than one sign each 25 feet of lot frontage.
b. the notice shallclearlyindicate, in not less thantwoinch high light-reflective letters on a contrasting
background,that unauthorized vehicleswill betowed away at theowner’sexpense. the words“tow away
zone” shallbeincluded onthe sign in not less than four inch high letters.
c. the notice shallalso providethename and current telephone numberof the person or firm towing or removing
thevehicles, if the property owner, lessor, orpersonin control of the property has a written contract with a
wrecker service.
d. the sign structure containing the required notices shallbepermanentlyinstalled with the bottom ofthe sign
notless than four feet abovegroundlevel,andbe continuouslymaintained on the property for not less than 24
hours priortothetowing or removal of any vehicles.
(3)Which has been lawfully towedonto the property of another atthewritten request of alaw-enforcement officer and
left there for a period ofnotless than 60 days without anyone havingmade claimthereto.
(4)Which has been abandoned, has anexpired license plate, oris inoperable in a parking area on private property
maintained by the property owneror his or her agentforuseby his or her tenants, residents, or their guests. Avehicle
shall be defined as abandonedor inoperable underthis subdivision if ithasanexpired license plateor has remained in
thesame parking lot for aperiodof 30 days or more. to bring a vehiclewithin the provisions of this subdivision,the
property owner orhisor her agent shall post a dated notice in a conspicuous placeon the vehicle in question stating:
a. that the vehicle has been determined tobe abandoned orinoperableandwill beremoved at the direction ofthe
property owner orhisor her agent upon the expiration of seven daysfrom the dateof the notice.
b. the name and addressof the last registered ownerof the vehicle in question and the nameandaddress of the
property owner orhisor her agent and a daytime phone numberforthe persongiving the notice.
Acopy of the notice shall be mailed byregular mail to the last known address of the registered owner, if
ascertainable,on the date of posting or not later than the next businessday. calculation of the seven-daynotice
period shallcommence on the date of posting ofthe noticeon the vehicle.
** note:section32-8-2, Code of Alabama 1975,defines a motorvehicleaseither:
a. everyautomobile, motorcycle, mobile trailer, semitrailer, truck, truck tractor, trailer and otherdevicethat isself-
propelled or drawn, in, upon, or bywhich any person orproperty is ormaybetransportedordrawn upon a
public highway except such as ismoved by animalpower or used exclusively upon stationary rails or tracks.
b. everytrailercoach and travel trailer manufactured upon achassis orundercarriageas an integral part thereof
drawn by a self-propelled vehicle.
Amanufactured home is not
definedasa motorvehicle under section 32-8-2, and cannot betransferred as an abandoned
motor vehicle.
