We Both Agree on How to Divide t he Debts
(Hold Harmless Provision)
Both spouses agree to divide their debts as listed above. The Plaintiff agrees to pay all the debts listed
under “Plaintiff’s Debts.” The Defendant agrees to pay all the debts listed underDefendant’s Debts. The
Plaintiff will not try to make t he Defendant pay his/her debts. The Defendant will not try to mak e the Plaintiff
pay his/her debts. Creditors will try to collect from both spous es. Bot h spouses understand this. A creditor
may get one spouse to pay the other spouse’s debt. If that happens, the spouse who is supposed to pay the
debt will pay the other spouse back. They will pay back any payments and reasonable lawyer’s fees the
spouse made. Th e y will pay back any costs of try ing to stop a creditor from collecting the debt.

Notice!
The Plaintiff and Defedant understand that the Final Decree does not necessarily
affect the ability of a creditor to pro ceed against a party or a party's property, even
though the party is not responsible under the term s of the decree for an ac cou nt, any
debt associated with an account or any debt. I t may be in a party' s best interest to
cancel, close or freeze any jointly held accounts. T.C.A. § 36-4-134.
This means that the Final Decree of Divorce does not protect you against creditors.
They may try to collect from you, even if your spouse is responsible for the debt. It
may be be s t to cancel, close, or freeze any ac counts you have toget her.
E
NTIRE AGREEMENT
This document says everything the Plaintiff and Defendant agreed to. They both
give up any legal claims they have against each other. Any other agreements
between them that are not in this paper are no longer any goo d. They cannot make
each other live up to any agreements that are not in this document.
W
ARNING - CHANGES (MODIFICATION)
After the divorce is final, the spouses may later want to change or drop parts of this
agreement. Changes must be put in writing and filed with the Court Clerk and
approved by the judge. You may w ant to talk to an attorney.
