PREMARITALAGREEMENT
ThisPremaritalAgreement(the“Agreement”)isenteredintobetweenName
ofPotentialBride,ofReno,WashoeCounty,Nevada,as"Wife,"andNameof
PotentialGroomofReno,WashoeCounty,Nevada,as"Husband,"withrefer-
encetothefollowingfacts:
WHEREAS:
A.HusbandandWifeareeachunmarriedandcontemplatingmar-
riagetooneanother.
B.HusbandandWifeintendtodefine,fixanddeterminecertainof
theirrightsandobligationsinthemarriage.
C.HusbandandWifealsointendtodefine,fixanddeterminetheir
rights and obligations inthe propertyof the other whenever and
whereveracquiredorlocatedandtorenounceanyclaimsorrights,
exceptforthisAgreement,whicheithermightacquireintheproperty
oftheotherbyreasonoftheirfuturemaritalrelationship.
D.Inaddition,HusbandandWifedesirebythisAgreementtoelim-
inateallalimony,supportandmaintenanceforeitherpartyinthe
eventofdissolutionoftheirmarriage.
E.ThisAgreementconstitutesapremaritalagreementasdefinedin
Nevada’sUniformPremaritalAgreementActandismadeincon-
templationofmarriage.ThepartiesintendthatthisAgreementwill
be construed and enforced pursuant to the provisions of the said
Act(NevadaRevisedStatutesChapter123A).ThisAgreementshall
be effectiveupon suchmarriage between thepartiesactually tak-
ingplace.Ifforanyreasonsuchmarriagedoesnottakeplace,this
Agreementshallbevoid.
F.HusbandandWifepossessadequateknowledgeoftheproperty
andfinancialobligationsoftheother,andtotheextentthateither
lacksadequateknowledge,HusbandandWifeherebyvoluntarilyand
expresslywaiveanyrighttodisclosureofthepropertyorfinancial
obligationsoftheotherpartybeyondthedisclosureprovided.
Basedupontheforegoing,HusbandandWifeagreeasfollows:

4OCCUPATIONS
1PURPOSE.
ThisAgreementshallestablishandcontrolHusband’sandWife’srights,title
anddutiesrelatingtoalltheassetsinwhicheitherorbothhaveaninterest
orshallacquireaninterestduringthetermofthisAgreementandtoallthe
liabilitiestowhicheitherorbothisobligatedorshallbecomeobligatedduring
thetermofthisAgreement.
2TERM
ThisAgreementshalltakeeffectuponthemarriageofHusbandandWifeand
shallremainineffectuntilthemarriageisdissolvedbydivorce,legalseparation,
orthedeathofeitherspouse.Intheeventofdeath,divorceorlegalseparation,
theassetsandliabilitiesofHusbandandWifeshallbecharacterizedasprovided
inthisAgreement,andtherightsandobligationsofHusbandandWifeshallbe
asprovidedinthisAgreement.
3CHILDREN
Intheeventthepartieshavechildren,HusbandandWifeagreeasfollows:
•Childrenshallberaisedinthe_________________religion.
•Intheeventofdivorce,
–HusbandandWifeagreethatHusband/Wifeshouldbeawardedfull
custodyofthe minorchildren, withreasonable visitationawarded
tothenon-custodialspouse,providedhoweverthatintheeventof
infidelity,the faithful spouse shall be presumed to be entitled to
custodyoftheparties’minorchildren.
–Thecustodialparentagreesnottomovemorethan15milesfromthe
homethemaritalhomewithouttheexpresswrittenconsentofthe
non-custodialspouse.
–Thenon-custodialspouseagreestosupporttheparties’minorchil-
dreninthemannerandamountthenagreedororderedbythedivorce
court.
4OCCUPATIONS
HusbandispresentlyemployedasaandWife
asa. HusbandandWifeagreethattheHus-
band’s/Wife’s(selectone)occupationshallbetheprimaryoccupation(herin
“Breadwinner”).TheWife/HusbandagreestosupporttheBreadwinnerandto
assisthim/herinadvancingwithinhis/heroccupation.

Husband and Wife agree to maintain their marital home in Reno,Nevada,
providedhoweverthatifBreadwinneristransferredtoanothercity,themarital
homeshallbemovedtothecitywherehe/sheistransferred.
6MARITALDUTIES
HusbandandWifeagreethatHusband/Wifeshallbeprimarilyresponsiblefor
performingnormaldomestichouseholdduties, suchascooking, cleaningand
washing.Husband/Wifeshallbeprimarilyresponsibleformaintenanceofthe
exterior,includingyard,ofthemaritalhome.
7PROPERTY
7.1SEPARATEPROPERTYOFWIFE.
AllofthepropertyownedbyWifeatthedateofmarriage,togetherwithall
acquisitionsbyWifeduringthemarriagebycompensation,gift,inheritance,or
personalinjuryaward,shallremaintheseparatepropertyofWife,regardlessof
thepersonaleffortsofWifeorHusbandintheowning,managing,acquiring,or
disposingofsuchproperty.Furthermore,alltherents,dividends,distributions,
issues,profits,appreciation,andotherenhancementsofvalueattributableto
Wife’sseparateproperty(includingwithoutlimitation,appreciationorenhance-
mentsofvalueresultingfromWife’sorHusband’spersonaleffortsorskills),shall
remaintheseparatepropertyofWife,andallpropertywhichispurchasedwith
theproceedsofasaleoforaloansecuredbytheseparatepropertyofWifeshall
beherseparateproperty.
AttachedheretoasExhibitA,whichhasbeeninitialedbyWifeandHus-
band,andincorporatedhereinbythisreference,isafinancialstatementofWife.
Wife’sfinancialstatementdescribestheseparatepropertywhichsheownsorin
whichshehasaninterestandtheseparateliabilitiestowhichsheisobligated
onthedateofthestatement.Wife’sfinancialstatementwillbesubstantially
thesameonthedateofmarriage.HusbandunderstandsthattheassetsofWife
havenotbeenrecentlyappraisedandthevaluesareestimatesonly.Husband
andWifebothagreethatanappraisaloftheassetswouldbetimeconsuming
andcostly.Husbandvoluntarilywaivesanyrighthemighthavetoacquireap-
praisalsofanyofWife’sassets.Husbandacknowledgesthattheactualvalues
oftheseassetscouldbehigherorlower. Husbandhassatisfiedhimselfthathe
isadequatelyawareofthevalueofWife’sassets,andhevoluntarilywaivesthe
righttobecomemoreawareofthevalueofWife’sassets,andherebyvoluntar-
ilywaivesanyrighttochallengethisAgreementbasedonthefactthatWife’s
assetsaredifferentinvaluethanthevaluessetforthinExhibitA.
Husbandfurtheracknowledgesandagreesthathehashadtheopportunity
toreviewanyinformationconcerningWife’sassetsthatheand/orhiscounsel

deemappropriate.
HusbandfurtheracknowledgesandagreesthatWife’sassetsmaydecrease
orincreasetremendouslyinvalue.ItisthedesireofWifeandHusbandthat
thisAgreementshallbebindingandenforceableirrespectiveofanychangein
circumstances.Husbandherebyvoluntarilywaives,discharges,andreleasesany
right,title,orinterestthathemightotherwiseacquireintheseparateproperty
ofWifebyreasonofthemarriage.
7.2SEPARATEPROPERTYOFHUSBAND.
AllthepropertyownedbyHusbandatthedateofmarriage,togetherwithall
acquisitionsbyHusbandduringthemarriagebygift,inheritance,orpersonal
injuryawardshallremaintheseparatepropertyofHusband,regardlessofthe
personalefforts ofHusband orWifein theowning, managing, acquiring, or
disposingofsuchproperty.Furthermore,alloftherents,issues,profits, ap-
preciation,andotherenhancementsofvalueattributabletoHusband’sseparate
property(including,withoutlimitation,appreciationorenhancementofvalue
resultingfromHusband’sorWife’spersonaleffortsandskills)shallremainthe
separatepropertyofHusband,andallpropertywhichispurchasedwiththe
proceedsofasaleoforloansecuredbytheseparatepropertyofHusbandshall
behisseparateproperty.
AttachedheretoasExhibitB,whichhasbeeninitialedbyWifeandHusband,
andincorporatedhereinbythisreference,isafinancialstatementofHusband.
Husband’sfinancialstatementdescribestheseparatepropertywhichheownsor
inwhichhehasaninterestandtheseparateliabilitiestowhichheisobligatedon
thedateofthestatement. Husband’sfinancialstatementwillbesubstantially
thesameonthedateofmarriage.WifeunderstandsthattheassetsofHusband
havenotbeenrecentlyappraisedandthevaluesareestimatesonly.Husband
andWifebothagreethatanappraisaloftheassetswouldbetimeconsumingand
costly.Wifevoluntarilywaivesanyrightshemighthavetoacquireappraisals
ofanyofHusband’sassets.Wifeacknowledgesthattheactualvaluesofthese
assetscouldbehigherorlower.Wifehassatisfiedherselfthatsheisadequately
awareofthevalueofHusband’sassets,andshevoluntarilywaivestherightto
becomemoreawareofthevalueofHusband’sassets,andherebyvoluntarily
waivesanyrighttochallengethisAgreementbasedonthefactthatHusband’s
assetsaredifferentinvaluethanthevaluessetforthinExhibitB.
Wifefurtheracknowledgesandagreesthatshehashadtheopportunityto
reviewanyinformationconcerningHusband’sassetsthatsheand/orhercounsel
deemappropriate.
WifefurtheracknowledgesandagreesthatHusband’sassetsmaydecrease
orincreasetremendouslyinvalue.ItisthedesireofWifeandHusbandthat
thisAgreementshallbebindingandenforceableirrespectiveofanychangein
circumstances.Wifehereby voluntarily waives, discharges, and releasesany
right,title,orinterestthatshemightotherwiseacquireintheseparateproperty
ofHusbandbyreasonofthemarriage.

7.3SEPARATELIABILITIES.7PROPERTY
7.3SEPARATELIABILITIES.
The financial statements attached hereto asExhibits A andB describe the
separateliabilitiestowhicheachspouseisobligatedonthedateofthemar-
riage.TheseobligationsshallremaintheseparateobligationsofHusbandand
Wife.Allliabilitieswhichareincurredintheacquisitionofassetswhichare
characterizedasseparatepropertypursuanttothisAgreement,andanyother
obligationswhichHusbandandWifeagreeinwritingtobeseparateliabilities,
shallbeseparateliabilitiesofthespousewhoownstheseparatepropertysoac-
quiredorofthespousewhohasagreedtobetheseparateobligor.Allseparate
obligationswhicharerefinancedduringthemarriageshallretainthecharacter
oftheoriginalobligation,regardlessofwhetherthenewobligationissecuredby
theseparatepropertyoftheobligororbycommunityproperty.Iftheseparate
obligationisrefinancedforanincreasedamount,theexcessproceedsfromthe
refinancingshallbetheseparatepropertyoftheseparateobligor.
Thecommunityshallbeentitledtoreimbursementfromtheseparateprop-
ertyoftheobligortotheextentthatcommunitypropertyisusedtopayany
partofanyseparateliability.HusbandandWifeshallbeentitledtoreimburse-
mentfromthecommunitypropertytotheextentthattheseparatepropertyof
eitherHusbandorWifeisusedtosatisfyanycommunityliability,otherthanthe
obligationofthecommunitytosupportandmaintainthespousespursuantto
Section7.7below. HusbandandWifeshallbeentitledtoreimbursementfrom
theseparatepropertyoftheothertotheextentthattheseparatepropertyofei-
therHusbandorWifeisusedtosatisfyanyseparateliabilityoftheother,other
thantheobligationoftheothertosupportandmaintainthespousespursuant
toSection7.7below.
Husbandherebyagreestoindemnify andhold Wifeharmlessfrom allof
hisseparate obligations, including, withoutlimitation, anyclaims, damages,
charges,assessmentsandtaxesrelatedtoHusband’sseparatepropertyorobli-
gations.
WifeherebyagreestoindemnifyandholdHusbandharmlessfromhersep-
arateobligations,including,withoutlimitation,anyclaims,damages,charges,
assessmentsandtaxesrelatedtoherseparatepropertyorobligations.
7.4EARNINGS
Allofthewages,salaries,bonuses,commissions,fees,dividends,distributions,
andotherearningsofHusbandandWifepriortothedateofmarriageshall
remaintheseparatepropertyofHusbandandWife, respectively.Allofthe
wages,salaries,bonuses,commissions,fees,dividends,distributions,andother
earningsofHusbandandWifeonorafterthedateofmarriageshallremain
theseparatepropertyofthespousewhoearnsorreceivesthem.Noneofthe
wages,salaries,bonuses,commissions,fees,dividends,distributions,andother
earningsforpersonalservicesrenderedbyHusbandandWifeafterthedateof
marriageshallbeconsideredthecommunitypropertyofHusbandandWife.In
addition,allappreciation,distributionsorotherenhancementsinthevalueof

theseparatepropertyofeitherspouseshallremainseparatepropertyevenifthe
appreciation,distributionsorotherenhancementsinvalueareattributableto
thepersonalskilloreffortsofeitherspouse.Allofthewages,salaries,bonuses,
commissions,fees,andotherearningsofHusbandandWifeafteranydivorce,
legalseparationordeathof eitherspouse, shallbe andremain theseparate
propertyofHusbandandWife,respectively.
7.5RETIREMENTPLANS.
7.5.1Wife’sRetirementPlans.
Husbandherebywaives,disclaims,andrelinquishesanyrightsorinterestswhich
Husbandmightotherwisehaveinanyqualifiedorunqualifiedemployeebenefit
plansorretirementaccountsinwhichWifecurrentlyorinthefuturepartici-
pates.HusbandandWifefurtheracknowledgeandagreethateventhoughthe
accountbalancesandotheraccruedbenefitsofWifemaybetheseparateprop-
ertyofWife,Husbandmightacquireadditionalrightsintheretirementinterests
ofWifeunderfederallawabsentthisAgreement.Husbandagreestoexecute
anywaivers,consents,elections,andotherdocumentsregardingsuchplansand
trustsandaccountsimmediatelyuponrequestbyWife.
HusbandandWifeunderstandandagreethatfromtimetotimecontribu-
tionsmaybemadetotheretirementplansandaccountsinwhichWifepar-
ticipates.Suchcontributionstotheplansandaccountscouldbeinterpreted
undercommunitypropertylaw,ifitwerenotforthisAgreement,toconstitute
thecommunitypropertyofHusbandandWife,butHusbandspecificallywaives
anycommunitypropertyinteresthemayhaveinandtosuchplans,trusts,and
accountsandHusband’sinterestthereinandacknowledgesforallpurposesthat
theplans, trusts,andaccountsincludingfuturecontributionsfromwhatever
source,andanyincome, issues,profits, appreciations,andotherincreasesin
valueshallbethesoleandseparatepropertyofWife.
NothinghereinshallpreventWife,bywritingexecutedafterthedatehereon,
fromgivingHusbandaninterestinanyretirementplanshemaynowhaveor
hereafteracquire.
7.5.2Husband’sRetirementPlans.
Wifeherebywaives,disclaims,andrelinquishesanyrightsorinterestswhich
Wifemightotherwisehaveinanyqualifiedorunqualifiedemployeebenefitplans
orretirementaccountsinwhichHusbandcurrentlyorinthefutureparticipates.
HusbandandWifefurtheracknowledgeandagreethateventhoughtheaccount
balancesandotheraccruedbenefitsofHusbandmaybetheseparateproperty
ofHusband, Wifemightacquire additionalrightsintheretirementinterests
ofHusbandunderfederallawabsentthisAgreement.Wifeagreestoexecute
anywaivers,consents,elections,andotherdocumentsregardingsuchplansand
trustsandaccountsimmediatelyuponrequestbyHusband.
HusbandandWifeunderstandandagreethatfromtimetotimecontribu-
tionsmaybe madeto theretirementplansandaccountsin whichHusband

participates.Suchcontributionstotheplansandaccountscouldbeinterpreted
undercommunitypropertylaw,ifitwerenotforthisAgreement,toconstitute
thecommunitypropertyofHusbandandWife,butWifespecificallywaivesany
communitypropertyinterestshemayhaveinandtosuchplans,trusts,and
accountsandHusband’sinterestthereinandacknowledgesforallpurposesthat
theplans, trusts,andaccountsincludingfuturecontributionsfromwhatever
source,andanyincome, issues,profits, appreciations,andotherincreasesin
valueshallbethesoleandseparatepropertyofHusband.
NothinghereinshallpreventHusband,bywritingexecutedafterthedate
hereon,fromgivingWifeaninterestinanyretirementplanhemaynowhave
orhereafteracquire.
7.6COMMUNITYPROPERTYANDLIABILITIES.
TheonlypropertywhichshallbecharacterizedascommunitypropertyofHus-
bandandWifeshallbepropertywhich
•HusbandandWifeagreeinwritingtobecommunityproperty,
•thetitletowhichpropertyisacquiredinthenamesofHusbandandWife
"ascommunityproperty"oras"communitypropertywithrightsofsur-
vivorship,"or
•anypersonalpropertyorbankaccountswhichareacquiredinthejoint
namesofHusbandandWifeas"jointtenants."
Anypropertyotherthanpersonalpropertyorbankaccountswhichisacquired
inthejointnamesofHusbandandWifeas"jointtenants"shallbetheseparate
propertyofHusbandandWifeintheproportionswhichtheyagreeinwriting
or,iftheydonotsoagree,intheproportionsinwhicheachcontributestothe
property.AnypropertywhichisacquiredinthenamesofHusbandandWifeas
"tenantsincommon"shallbetheseparatepropertyofHusbandandWifeinthe
proportionsspecifiedinthedocumentoftitle,andifnoownershipproportions
arespecified,thenthepropertyshallbeconsideredownedintheproportionsin
whicheachcontributestotheproperty.
Intheeventpropertyownedbyeitherspouseistransferredtoatrustof
whicheitherHusbandorWifeissoleTrusteeand/orbeneficiary,orHusband
andWifeareCo?Trusteesand/orbeneficiaries, thepropertyshallretainthe
characterinwhichitwasimmediatelypriortothetransfertothetrust,unless
otherwiseagreed,inwriting,byHusbandandWife.
IfanypropertyisacquiredbyHusbandandWifeascommunityproperty
pursuanttotheforegoingprovisions,thenalloftherents,issues,profits,ap-
preciation,andotherenhancementsofvalueattributabletosuchcommunity
propertyshallremaincommunityproperty,andallproceedsofandallproperty
whichispurchasedwiththeproceedsofasaleoforloansecuredbycommunity
propertyshallbecommunityproperty.
Allliabilitieswhichareincurredintheacquisitionofanyassetswhichare
consideredtobecommunitypropertypursuanttotheforegoingprovisions,and

anyotherliabilitieswhichHusbandandWifeagreeinwritingtobecommunity
liabilities,shallbedischargedfromthecommunitypropertyofHusbandand
Wife.Ifcommunityliabilitiesaredischargedwiththeseparatepropertyofeither
spouse,thentheseparatepropertyofthespousewhichpaidthecommunity
liability shallbeentitledtoreimbursementfromthe communitypropertyof
HusbandandWife.
7.7SUPPORTANDMAINTENANCEOFSPOUSESDUR-
INGMARRIAGE.
DuringthemarriageofHusbandandWife,allthelivingexpensesofHusband
andWifeshallbepaidwiththeseparatepropertyofthespouseincurringthe
expense,unlessotherwiseagreedtobyHusbandandWife.Further,intheevent
HusbandandWifehavechildren,thelivingexpensesofthechildrenshallbe
paidfromthecommunitypropertyofHusbandandWife,andtotheextentthat
thecommunitypropertyofHusbandandWifeisinsufficient,equallyfromthe
separatepropertyofHusbandandWife.Livingexpensesshallbeconsidered
toincludeallexpensesforfood,clothing,shelter,entertainment,travel,educa-
tion,medicalanddentalcare,householdsupplies,andautomobilerepairsand
maintenance.
7.8ALTERINGTHECHARACTEROFPROPERTY.
Husband and Wife can alter the character of their property,whether it be
separateorcommunity, onlybyjointlyexecutingawritten documentwhich
provides
•aspecificdescriptionoftheproperty,thecharacterofwhichistobeal-
tered,and
•thenatureofthealterationinthecharacteroftheproperty.
Ifonespousemanagestheseparatepropertyoftheotherorassumesallman-
agerial responsibilities ofthe communityproperty, whetherby agreement of
the spouses or otherwise,the character ofthe property, including all rents,
issues,profits,appreciation,otherenhancements,andpropertyacquiredwith
theproceedsfromthesaleoforaloansecuredbysuchproperty,shallremain
unchanged.
Neitherthecomminglingofcommunitypropertywiththeseparateproperty
ofonespousenorthecomminglingoftheseparatepropertyofonespousewith
the separate propertyof the othershall alter the character of the property
commingled.
7.9MANAGEMENTOFPROPERTY.
HusbandandWifeshalleachmanagehisorherownseparateproperty.Hus-
bandandWifeshalleachhaveequalrightsandobligationsinmanagingtheir

communityproperty.Eitherspousecanassignhisorhermanagerialrightsand
obligationstotheotherbyexecutingapowerofattorneyspecifyingtherights
andobligationsassigned.Suchapowerofattorneyshallhavenoeffectuponthe
characterofthesubjectproperty.Inaddition,HusbandandWifeeachagreeto
signanyquitclaimdeeds,powersofattorney,loanapplications,orotherdocu-
mentswhicharerequiredbytheotherspouseinmanaginghisorherseparate
propertyandliabilities;providedthatthespouseshallnotberesponsiblefor
anyoftheobligationsorliabilitiesoftheotherspouserelatedtosaidspouse’s
separateproperty.
7.10PROPERTY/SUPPORTRIGHTSUPONDIVORCE
ORSEPARATION.
IfeitherHusbandorWifeshallseekadivorceortobecomelegallyseparated,
HusbandandWifehereby,agreethatneithershallbeentitledtospousalsup-
port,separatemaintenance,alimony,preliminaryallowances,orattorneys’fees
relatedtotheissuesdescribedinthisAgreementfromtheotherspouse.Hus-
bandandWifefurtheragreethatuponthedivorceorlegalseparationofthe
spouses,eachshallbeentitledtoreceivehisorherownseparatepropertyand
one-halfofanycommunitypropertywhichisacquiredbythespousespursuant
tothisAgreement.HusbandandWifeeachherebywaive,discharge,andrelease
allclaimsandrightsthatheorshemayotherwisehavebyreasonofmarriageto
shareinthepropertyoftheotherspouseupontheirdivorceorlegalseparation.
7.11RIGHTSUPONDEATHOFASPOUSE.
Eachspousewaives,discharges,andreleasesallclaimsandrightsthatheor
shemightotherwiseacquireintheestateoftheotherspouseuponthedeathof
theotherspouse(including,butnotlimitedto,therighttoserveaspersonal
representativeofthedeceasedspouse)exceptasfollows:
•Thesurvivingspouseshallbeentitledtothesurvivingspouse’sone-half
(1/2)ofanypropertywhichisthecommunitypropertyofthespouses
pursuanttothisAgreement.
•Thesurvivingspouseshallbeentitledtoanypropertywhichisspecifically
transferredtothesurvivingspousebybeneficiarydesignationorunderthe
termsofthewill,trustagreement,orothervalidformoftestamentaryor
intervivosdispositionofthepropertyofthedeceasedspouse.
•Thesurvivingspouseshallbeentitledtoanypropertywhichisexpressly
ownedjointlyorascommunitypropertywithrightsofsurvivorshipby
HusbandandWife.
•Thesurvivingspouseshallbeentitledtoallpropertyforwhichthede-
ceasedspousemakesnotestamentaryprovisionandtowhichthesurviving
spouseisentitledunderlawsofintestatesuccession.

8MISCELLANEOUS.
•Thesurvivingspouseshallbeentitledtoserveaspersonalrepresentative
oftheestateofthedeceasedspouseifspecificallynominatedassuchinthe

8MISCELLANEOUS.
•TerminationorAmendment. ThisAgreementcanonlybeterminatedor
amendedbywrittenagreementexecutedbyHusbandandWife.
•GoodFaithandFairDealing.Thisagreementshallbeunderwrittenby
thedutyofgoodfaithandfairdealing.
•ApplicableLawandChoiceofForum.ThisAgreementshallbegoverned
by andconstrued inaccordancewiththelawsofthe Stateof Nevada.
Furthermore, ifadivorceis everpursuedbyeitherof theparties, and
eitherofthepartiesisthenaresidentoftheStateofNevada,thenthe
DistrictCourtinWashoeCounty,Nevadashallhaveexclusivejurisdiction
tograntadivorceand todetermine allthe issuesprovidedfor inthis
Agreement.
•GenderandNumber.AsusedinthisAgreement,themasculine,femi-
nine,andneutergender,andthesingularorpluralnumber,shalleachbe
consideredtoincludetheotherswheneverthecontextsoindicates.
•SuccessorsandAssigns. ThisAgreementshallbebindinguponandshall
inure to the benefit of the legalrepresentatives,heirs,successors,and
assignsofHusbandandWife.
•IndependentCounselandFullDisclosure.HusbandandWifehaveeach
beenadequatelyrepresentedinconnectionwiththisAgreementbycounsel
ofhisorherownchoosing, andeachhashadsufficientopportunityto
obtaintheadviceofthatattorneywithrespecttothisAgreement. Each
hasreadthisAgreement,hasbusinessexperienceandacumensubstantial
enoughtounderstandit,wasnotcoercedintomakingarashdecisionby
thecircumstancesunderwhichtheAgreementwassigned, hashadthe
contentsofthe Agreementfullyexplained tohim orher byhisor her
legalcounsel,andisfullyawareofthecontentsandlegaleffectsthereof,
includingtherightsthat,butforthisAgreement,wouldbeconferredby
lawuponhimorherbyvirtueoftheproposedmarriageandtherightsheor
sheisforfeitingbyexecutingthisAgreement.Eachbelievesandrepresents
totheotherthatheorsheisnotgreatlydisfavoredbythisAgreement,
and,therefore,nopresumptionoffraudshallarisewithrespecttothis
Agreement.EachbelievesandrepresentstotheotherthatthisAgreement
isnotunconscionable.HusbandandWife haveeachenteredintothis
Agreementwithadequateknowledgeofthefinancialresourcesoftheother.
HusbandandWifeherebyvoluntarilyandexpresslywaivefurtherrightto

additionalfinancialdisclosuresbytheotherpartyandwaiveanyrightto
raisethelackoffairandreasonabledisclosureoffinancialresourcesasa
reasonfornotenforcingthisAgreement.
•Severability.Theunenforceability,invalidity,orillegalityofanyprovision
of thisAgreement shallnot render theother provisionsunenforceable,
invalid,orillegal.
•EntireAgreement.ThisAgreementsupersedesallprioragreementsand
containstheentireagreementofHusbandandWife.Nootheragreement,
statement,orpromisemadebythepartiesoranyagentofapartythatis
notinwritingandsignedbybothHusbandandWifeshallbebinding.
•Changing Circumstances.Husband andWife hereby acknowledgeand
agreethatlifeisunpredictableandcircumstanceschange.ThisAgreement
isexecutedwiththefullknowledgeandexpectationthatinspiteofthe
manychangestothefinancialcondition,employment,physicalcondition,
mentalcondition,oranyotherchanges,whetherconsideredtobematerial
orimmaterial,toeitherorbothofthepartieshereto,oranychangeswith
respecttoexternalfactorssuchastheconditionofthenationaleconomy,
itisthedesireandintentofthepartiesthatthisAgreementcontinueto
bebindingandinfullforceandeffect. Further,notwithstandingtheem-
ploymentorterminationofemploymentofeitherpartyinthefuture,both
partiesintendtocontinuetobeboundbythetermsofthisAgreement,
haveconsideredthepossibilityofsuchoccurrencebeforeenteringintothis
Agreement,andpriortotheterminationofanyemploymentwillconsider
theconsequencesinlightofthisAgreement.
•JointIncomeTaxReturns.NotwithstandingthefactthatHusbandand
Wifemayfilejointincometaxreturnsduringtheirmarriage,suchreturns
shallnottransmutethecharacterofanyseparatepropertyofHusbandor
Wifetocommunityproperty.
•Captions.The captions in thisAgreement shall have no effect on its
interpretation.
