Lessor agrees to lease to Lessee (B. & J. Cattle Company) the above property for the purpose of
cattle grazing under the following terms and conditions:
1.Effective Date of Lease: Beginning: ______________ Ending: _________________
2.LessoragreestopayLesseethesumof$10.00peracreperleaseperiodforthe
maintenance and upkeep of the above open pasture land owned by Lessor(s).
3.ThisagreementmaybeusedforapplyingforAgriculturalTaxStatustotheCounty
Assessor’sOffice,MaricopaCounty Arizona.Designationofsuchstatusisatthesole
discretion of the Maricopa County Assessor’s Office.
4.Lessor remains responsible for non-pasture land maintenance (e.g., trash cleanup).
5.LesseeshallpasturetheminimumormoreheadofcattletoqualifyforAgricultural
Grazingstatus.Lesseeshallbesolelyresponsibleforthecareofthepasturedlivestock
andLessorshallnotberesponsiblewithrespecttodeath,injury,orlossneitherof
livestock nor damage caused to fencing, equipment, etc., caused by the livestock.
6.Lessee shall not make any improvements without Lessor’s written permission.
7.Lesseeindemnifies,defends,andholdsharmlessLessorwithrespecttoanyclaimfrom
loss or damage to persons or property arising out of Lessee’s use of property.
8.Thisagreementshallbesubordinatetoallpresentandfuturegroundleases,mortgages,
deeds of trust, or any other encumbrances by Lessor. In the event of sale or alienation of
Lessor’s interest in the property, this lease shall terminate (not assignable).
9.Allnoticesshallbeinwritinganddeliveredtotheaboveaddressesunlessnotifiedin
writingofanychangesinaddresses.LessorshallnotifyLesseeofanysaleofthe
property, including contact information of the new owners.
10.Lease will be delinquent after 60 days written notice by either party.
