STANDARD LEASEAGREEMENT (Short Form)
(One Time Use, Maximumof Three Days)
This LeaseAgreement (the "Lease") ismade and entered into effective as of _____________, 20__,
under an agreement with the Presbytery of San Jose, a non-profit Californiacorporation (the
“Presbytery”), between ______________________ Presbyterian Church, a non-profit California
corporation (the “Church”) (the Presbyteryand the Church hereinafter collectivelyreferred to as the
"Landlord"), and ____________________________________________________ (the "Tenant" – could
also be a vendor or contractor).
For good and valuable consideration, the parties agree as follows:
1.Premises.Landlord, in consideration of the lease payments provided inthisLease, leases to Tenant
the following space in the church facilities:

2.Term. The lease term shall commence on _______________, 20__ and shallterminate on
______________, 20__.
3.Lease Payments. Tenant shallpay toLandlord a sum of _______________________________
Dollars ($______) includinga non-refundable/refundable (cross out the appropriate choice) security
deposit of _______________________ Dollars($______).
4.Condition of Property. Tenant has inspected the Premisesand hereby accepts the Premises “ASIS,”
in the condition existingas of the date hereof.
5.Damage to Premises. Tenant will be liablefor anydamage to the facilities and/or furnishings in or
about the Premises resulting from the acts oromissions of Tenant, Tenant's guests or Tenant’s third
party vendors and service providers. Tenant shall immediately reportanysuchdamage toLandlord.
In the event of such damage, the repairs will be carried out by Landlord andpaidfor by Tenant.
6.Liability Insurance. Tenant shall obtain for the term of the Lease at Tenants expense, incompanies
and through brokers approved byLandlord, public liabilityinsurance with personal injury limits of at
least $1,000,000 for injuryto one person, and $1,000,000 for anyone accident, and a limit of at least
$1,000,000 for damage to property. Landlord shall be named as an additional insured on such
insurance policy. Tenant shall deliver to Landlord a certificate of the insurance carrier tothe
issuanceof suchpolicy before the beginningdate of the term of thislease.
a.Tenants that hire service providers, individualsor subcontractorswill also provideevidenceof
their current liabilityinsurance, current Workers Compensation insurance, appropriate auto
liability coverage and evidence that the churchhas been named as an additional insured for the
time of the LeaseAgreement.
7.Indemnity Regarding Tenant’s Use and Activities. Tenant assumes responsibility and liabilityfor
and agrees to indemnify,holdharmless, and defend Landlord fromand against any and all claims,

losses, liabilities, injuries (including death), obligations, damages, andexpenses, including reasonable
attorneys fees, if any, which Landlord may suffer or incur that are occasioned whollyor in part by or
result from anyacts or omissions by Tenant or Tenant's agents, employees, guests, licensees, invitees,
subtenants, assignees or successors, or thatfor any cause orreason whatsoever arise out of or relate
to Tenant's use of the Premises or Tenant’s activities, including without limitationclaims of sexual
misconduct, harassment, abuse, or molestation. Tenant shallforthwithnotifyLandlord inwriting with
a full description of the facts; the place, circumstances, nature and results; and the names and
addresses of involved parties with regard toanyoccurrences on the Premises which involveany injury
to person or property. Tenant will provide Landlord promptly with copies of any claims for damages
of anysort, including complaints in any courtactions involving such claims.
8.Compliance with Laws. Tenant shall,at its sole cost and expense, complywith allrequirements of
all municipal, state,and federalauthorities now or hereafter in force pertaining to its use of the
Premises. The judgment of any courtof competent jurisdiction, or the admission of Tenant inany
action or proceeding against Tenant, whether the Presbytery or the Church be a party theretoor not,
that Tenant hasviolated anysuch legal requirement shall be conclusive of thatfact as between
Landlord and Tenant.
9.Dangerous Materials. Tenant shall not keep or haveon the Premises any articleor thingof a
dangerous, inflammable, or explosivecharacter that might substantially increase the danger of fire on
the Premises, orthat might be considered hazardous by a responsible insurance company, unless the
prior written consent of Landlord isobtained and proof of adequate insurance protection is provided
by Tenant toLandlord.
10. Keys. Landlord willassign____ sets of entrance keys to Tenant. Tenant willnot copy any keys
provided byLandlord and will carefully supervise the use of keys provided to maintainsecurity of the
Premises.
11.Safe Environment. Tenant agrees that it willcomply with the following statement, as required by
the Safe Church Task Force of the Presbytery:
"Organizations using the facilitiesof the Church shall provide a safeand nurturingenvironment for
children, youth and vulnerable adults andthose who work with them.They must abide by the current
SafeChurch Policy of the Church or provide proof thattheir organization has a similarpolicy in
place."
IN WITNESS WHEREOF, the parties have executed this Lease effective as of the dayand year first
above written.
